A few months ago my nephew was hired for his first nursing role in which a positive marijauna pre employment drug test came back. Consequently, he was terminated. Will he be reported, as prior to this, he has not worked any job in over a year due to the pandemic and has never worked as an RN yet ? 

Secondly, if he is reported, what does a BON investigation look like in these cases? What would the investigation consist of?

For reference, he just got his license in December 2020!

The investigation process does take a while. I am in Mississippi. I was reported to BON Jan 2016 for diversion of narcotics . I met with an investigator in March 2016 then I didn’t get a notice from the BON til oct 2019!! I worked the whole time since my license was clear and active.  I suggest u get another job and stay clean.  I went to rehab and AA NA meetings then when the BON finally got to me I was placed on probation. I’m working and all is well.  If all goes well I get off probation this October!

It’s really up to the employer; I believe it’s supposed to be reported but sometimes if it’s a pre-employment screen, it’s not. It’s really a crap shoot. Marijuana stays in the system for awhile so I would advise your nephew to not partake for awhile and then do an over the counter test prior to see if he’s clean prior to applying for other jobs. Most jobs do a pre-employment drug screen. Good luck!

Major hospital systems will report positive pre-employment tests to their state BON. I’d tell him to stay 100% clean, b/c when they do investigate they will for such drug test again

I believe every BON has a zero tolerance policy regardless of legal status of recreational marijuana in that state. I could be wrong though as every state has their own rules and regs. 

That being said for a pre-employment screen I'd think the odds of being reported to the BON in a legal state would be lower.  Though I do believe the option of reporting a positive pre-employment screen is totally dependent on the policy of the potential employer no matter what state this is in. 

The potential consequences of a positive pre-employment screen should be somewhere in the written consents your nephew certainly had to sign when he took the test.  He should've been provided with a copy, have him read through it carefully and it may just answer the question.

That sucks. He will probably be reported which is so wrong in my opinion.
