Legal problem + advice on WA DOH

Hi guys,

In 2010 I was convicted of a gross misdmeanor (attempted theft in the second degree). I got a 24 month deffered sentence. That 24 month has come to an end and I can get my record expunged.

This was before I decided to pursue a Nursing career. I recently applied for my NAC license in Washington state. I was denied the license and have requested a hearing with department of health. I was hoping someone could give me advice as to how I should approach the hearing. Since I can't afford an attorney I to have repersent myself.

If I reapply for the license once my record is expunged (the background check is cleaning of any crimianl history) will the DOH deny it again because now they have a record of my background. The file that Washington DOH have on me, will it be thrown out eventually or will they always have it with the information that I once was convited of a gross misdemenaor.

We can't offer legal advice but what I can suggest is sometimes it is worth hiring a lawyer used to dealing the the BON to ensure you get the best deal.

Why didn't you wait till after your record was expunged?

I would seriously consider hiring a lawyer.

Either way, I would make sure your record is expunged before the hearing is scheduled.

Your concern about what kind of record does WA DOH keep is also my concern as well. Since I'm not 100% sure if they will find my charges (none of them are conviction, nor guilty plea) from WSP background check, I'm very hesitent of disclosing it volunteerly since that record will be kept by WA DOH forever... Oh well, I have to take chance either way and I rather take chance by disclosing it rather not disclosing. Wish me luck.

Sorry I wasn't asking for legal advice. I was hoping that someone who has gone through a similar problem might give me some info as to how they dealt with it. Maybe a little about what the WA DOH is like.
