visa screen certificate

hi! I am a registered nurse from the Philippines. I understand that I need visa screen certificate to be given by the CGFNS in order for me to work in the US with an immigrant visa..

Now the problem is CGFNS will not give Visa SCreen certificate for the June 2006 nursing board passers because of the leakage issue. My question is how about if I'll pass the NCLEX and eventually get my nursing license in the state where i am applying, will CGFNS still denies me a visa screen? If so, it is tantamount that they are questioning the integrity of their NCLEX exam?

Please give some insights on this matter.

Sorry, but you are misinformed. It has nothing to do with the NCLEX-RN exam but everything to do with the June, 2006 NLE exam. If you never took that exam, there would be no issue. But since you took it, the results were not accepted by CGFNS and the exam needs to be repeated. You are new here, but we have been suggesting that this be done since last fall and many did do that. This is nothing new, they had put the VSC on hold months ago, while they were investigating and now have made it official.

CGFNS will still deny you the VSC as it is based on that NLE exam and nothing more. And they have the right to do that, since it was proven that the exam was not handled as the exam should have been. This is something that you need to take up with the PRC, not the US government.

And please be aware that CGFNS is under contract to the US Government, federal level, o provide a contracted service for them. They do not make the rules, the US government does.

Unfortunately, it is already too late for the ones who already have the license via the June 2006 NLE.

Yes, it would have been much better if you have not taken the NLE at all and CGFNS/ICHP itself would have waived that req't for you.

After the CGFNS decision came about most are thinking to not disclose that they ever took the NLE but that can't be done as well because doing so would mean mis-representation and outright denial or grounds for revoking the certificate if the said certificate were issued by applicants withholding information.

This is the reason why I gave a friendly reminder in the Phil. forum as most do not know that doing so is considered fraud/mis-representation.

You cannot waive a license that you already have. You are already listed as having it, and to do otherwise would be considered providing false information to the US government and grounds for being not permitted to get a visa, or even deported once you are there.

You need to follow the US government rules if you wish to work there, not those of your government. They do not exist in the US.

if you lie it is classed as fraud and can lead to deportation if already in the US. I am sure there is a way of checking especially with all the things that have been happening regarding the june 06 exam. With anything always better to tell the truth if not it can always come back and kick you up the backside

Then you have falsified information to the US government and that is grounds for not getting the VSC or even getting deported. You can never withhold information like that. And yes, they will know.

Lying is a bad thing to do, as it states that you will lie about anything else.

CGFNS represents the US Federal Govt, and would you lie to them? That is what you would be doing and it could get you into trouble. The others that have bragged about doing same will be investigated. CGFNS, as well as members from the Board that handles the NCLEX exam also read these forums, as well as US immigration officials.
