hello all, as i understand there are 2 ways to get to the USA, CP and AOS.. i took the AOS route, and i was wondering, when can i expect to see my GC

my PD is sept 28, 2006-- my file says it is still under review...

it is located in the TEXAS SERVICE CENTER-- when can i have a visa allocated for me? also will i have to wait until october to get a visa?

just to add, tell your friend they would do better starting the process now because by the time visas are sorted which could be next year, they could be well into the process and not have long to wait by doing it properly

the only thing that can be filed at the moment is I140. If he is in the US he can not file for anything else and could easily become out of status and put everything at risk. For consular processing (CP) only the I140 can be filed at this moment and it is taking up to 9 months to get approval

Where is your friend at the moment?

The big question for the original poster here is if you have received approval on the I-140 and the I-485? That is what will influence if you get a green card now. Even in good times when there are visas available, average wait time for the green card is about 8 months with the AOS, it is never automatic.

And everything went to a snails' crawl when the retrogression started last fall.

As mentioned above, be very happy that you have the EAD.

Silverdragon102, he's here in the Philippines. He plans to go to the US for a vacation with family...so he was thinking if by luck by the time he is there, AOS will be then accepted. But, he's in dilemma right now. If he'll apply I-140 now thru his lawyer+hospital is there such thing as filing AOS when he'll be in the US? make some changes if ever.

my friend is on eb3 category, packet 3 stage. she is being asked by her lawyer to submit an updated ds230 along with OP169. what's OP169? why is she asked for this form?

As you may now be aware, filing for AOS has been put on hold again w/ the recent reversal of the Visa Bulletin. AOS can only be filed if the category would be current, otherwise they are not allowing it.

Ever since retrogression begun for nurses, no AOS was allowed to be filed and as far as the EB3 category is concerned, of w/c the nurses are now part of ever since the 50,000 visas were exhausted for Schedule A, it has not been current since the January, 2005 Visa Bulletin.

yes my I-140 has been approved, and i have posted the letter USCIS have sent me on page 1 of this thread....

so is there a possible way that i was allocated a visa number?

You just started the process before the retrogression kicked into place. Seriously doubt that you will get a visa from one of these that were recapped. There are many that are much before you. Just got your petitions submitted a month before it started.

Remember that things got put on hold after the I-140 was submitted. I would not expect to get anything from these visas at this time, there are many that have been waiting much longer.

I would not count on anything or doing anything on the basis of you getting a green card at this time from these visas.
