When did you do the AOS route? You will not get a GC until visas are available which may be longer than October as we don't know yet what is going to happen then

i got my PD @ the end of sept 2006. i got my EAD-- OCT 12.

this is the latest email i got from USCIS--

you are lucky as you have EAD and can keep renewing it until you get a visa allocated

so i have to wait for the visa to be allocated huh? um when will that be, this coming OCT? also i wasnt included in the 60000 visa that was released last month?? is there no possible way?

the EAD can be renewed while waiting for the visa allocation?

the EAD can be renewed while waiting for the visa allocation?

Yes, It is good for 1 year and renewable as long as the Adj. of Status is still pending. The EAD is only available for those who have filed for AOS.

oh okay..thank you lawrence for the info. by the way, do you think its a good idea that by oct you'll file AOS? as what i learn AOS application will be received this oct? thank you

You can't file AOS as you are in the Phillipines, plus this is not a recommended route to file with immigration

no one knows what will happen in Oct, you do have a chance to getting a visa but you can just renew your EAD whilst you are waiting

oh okay..thank you lawrence, but if ever he has a tourist visa can he file for AOS? this is an inquiry of a friend. thank you

It is against US immigration to travel to the US with a tourist visa and change status. Even if you go this route you are looking atleast 90 days before you can file and can take a few months before you get EAD and until that time you can not work so must support self. Even then you are still at risk of it being denied. This has been discussed a few times have you tried using the search facilities?
