immigration petition

Hi! I am now waiting for my interview schedule but my problem is that my employer recently demanded that I should pass the NCLEX otherwise they will not issue a sponsorship paper for me to bring during my interview and would eventually revoke their sponsorship. I applied for NCLEX only this FEB and until now I haven't received my Letter of Eligibility from Ca BON. My fear is that my interview might be set 3rd quarter of this year. If ever they will revoke their sponsorship granting I did not pass the NCLEX and I choose to sign up with a new employer would this mean that I have to start processing my petition again from the very beginning or will my current petition remain applicable for my new sponsor?

Please help.

Petitions are 100% emplyer driven, meaning that if you change emplyers, you start from Day One. And to be very honest, your enplyer is doing the right thing. There are too many that are coming over and their employer never filed for them to take the exam before arriving, and they are stuck in the US without work.

The US Embassy in Manila is now requesting proof of the NCLEX exam, at least some of the interviewers are, and are refusing to even issue the visa until they see that they have passed. Your employer is actually doing you a favor.

Thanks for your reply. I just have to pray hard and study harder so I could pass the NCLEX. They told me the exam is so difficult and that scares me. Btw, do you have any idea how am I be able to contact Ca BON to confirm my papers? I emailed them more than a month ago but they never replied.

Thanks!:)

If you aplied only in Feb. you will have to wait for 4-6 mos.

Friends of mine that applied from the month of Sept. onwards only got their letter of eligibility in 6 mos.

The NCLEX-RN is much easier that the CGFNS exam. You will not hear anything for four to six months...............

Is this true? I am now waiting for my US Embassy interview schedule and only have the Visa Screen, CGFNS passing docus and employment contract. My employer is scheduling my NCLEX to be taken in the US. So, will it be an issue in my interview that I still have to take my NCLEX? Isn't CGFNS sufficient atleast for interview purposes?

Depends on your interviewer at the Embassy. Do you know for a fact that your application for licensure in the US has been submitted? This is what is causing all of these new problems and why they are asking for the NCLEX passing. There have been employers that have not sent in the applicaiton until the nurse arrives in the US, and that means that the nurse will not get paid until they pass the NCLEX, and that can be four months or more. It is quite terrible to do to someone. That is why I always recommend that the NCLEX-RN be done when possible before the nurse comes to the US.

Who is your employer?

i agree with suzzane, NCLEX is not that hard , just study, dont panic on the exam and you will be ok, i find nclex easier than cgfns, or our own board exam in the philippines. i think the hard part mostly for some is because they are still in the philippines and the way we practice nursing there is a little bit different so base your answers on what you've learned on the books but not on the way you practice in the philippines.

i need an opinion/answer please...

i am currently adopting a child. there's no court order yet (meaning, no birth certificate in my name yet) i already received the DS 230. and it states there that i have to provide the birth certificate of a dependent/s i wish to migrate with...i really want to bring this child with me. anybody has any idea??? thanks...

the process and requirements for nclex exam differ in every state as well as how long it will take. I got my ATT after 3 months of processing. and i fortunately passed it. :)

here's my personal take on your dilemma...

assuming that you're done with all requirements making the adoption legal, and now you're just waiting for the court order? pray that it comes out before your embassy interview.

i think you can go ahead with the filing of your own DS230, ahead of this child, since you can apply a legal dependent (file the DS230, pay the visa fee) at the embassy on the day of your actual interview. as long as you have all the legal documents supporting the adoption, of course.

SAFE THING TO DO IS, PLEASE DOUBLE-CHECK / CONSULT WITH YOUR IMMIGRATION LAWYER.

good luck.
