i just want to know how long does it take to have an h1b approval.i was filed last oct 2009 and until now my status is still pending and its still in the initial review process i haven't got any request for evidence..i'm so worried i don't know what's going on to my visa application..by the way i'm here in the US while waiting for my h1b approval..
Herheys, the premium processing that ghillbert mentions has to be applied for at the same time as it is filed (to the best of my knowledge) I strongly suggest you find a immigration lawyer and get a second opinion. Also make sure that the lawyer has experience with H1b and nurses/dieticians

Yeah I was filed with the premium process that's y I'm really bothered cause by now I should have an answer already..maybe my agency just took away the money for the premium..anyways,I talked to a lawyer and he said the best way for me to do is wait and if I'm going to decide to go home now I'll be banned for 3 years but if I reached until oct 2010 then decided to go home that time I will be barred for 10 years..sigh..so maybe I'm just gonna wait for my h1b to get approved before my time runs out..this is really heavy for me..
Oh geez!!!!! You're backed into a corner! You leave, and you take a risk, you stay you're really taking a risk, and you leave in October you're still taking a risk. The agency really put one over on you. So sorry!
yeah there's really no easy way out..but my agency told me if i go home i wont be banned cause i have a pending petition and approved I140 and still i can come back when my h1b get approved..so confusing..i don't know which way should i believe in..i really need a 3rd 4th opinion regarding this..
I have never heard of you not being banned because you have a pending approval, I really do suggest you check that out with a lawyer. The US doesn't care about that and if that was the case all the people with immigrant or H1b approval do not have to wait for a interview but come over to the US and start working
If I was in your shoes I'd go straight to the UCIS office and talk to an immigration official in person.

hi! to just give u an update on my case..the paralegal of my agency went to the uscis already using the infopass and they informed me that my file is not processing because tons of application is still for review..they said that they're going to pulled it out and continue to review my case..i don't know if this is true or my agency is just making an excuses..i need the result as soon as possible but so frustrating the fact that it is beyond my control!does anyone have the same situation as mine?

Well you can't apply for a job as a RN because it wont work. When applying for work they will require you to submit paperwork stating that you're authorized to work in the US, and they will know that with a H1b visa, another employer would have petitioned you.
I suggest that whatever your attorney tells you, you should do it immediately. You really don't want to risk being out of status as you are at the moment. Good luck and I hope everything works out for you.
