i just want to know how long does it take to have an h1b approval.i was filed last oct 2009 and until now my status is still pending and its still in the initial review process i haven't got any request for evidence..i'm so worried i don't know what's going on to my visa application..by the way i'm here in the US while waiting for my h1b approval..

What visa are you in the US with? Just make sure you do not become out of status as that may have an impact on your H1b. There could be many reasons why you are still waiting but I would have thought you would have heard something by now. Does your lawyer have any suggestions?

What is your nursing specialty? As you have been reading on the boards here, nursing jobs are hard to come by. If you have a specialty in demand it will help. Also does your hospital still have an opening ?
my case is complicated..i am a b2 status but i already overstayed my 1-94 i didn't leave the US because my agency told me that i can stay cause i have a pending petition and also have an approve I140 which still i am waiting for my priority date.. i was not petition as a nurse in specialty in h1b cause i am not qualified so the agency filed me as a dietitian which i am also a holder of bachelor's degree for that and i met the requirements..so i was filed last year and its been 6 months haven't got any response for the USCIS i only got the notice of receipt and my case is still in the initial review process they told me just wait but until when should i wait..its really frustrating and i cannot go home either cause i know there's no chance for me to come back here and i'll be banned for 10 years because i overstayed..i really don't know what to do right now.. please help..
lastly. if this is because of the overstayed I94 they should have send me a denial notice..whats taking them so long..?
My advice get an immigration lawyer.
I would suggest you have a chat with a lawyer yourself because as far as I am aware you shouldn't overstay your visa as it can have consequences

I can't believe you waited 6 months to find out when you're in overstay position!
Make an InfoPass appointment at USCIS to find out about your application?
You can pay to have your H1B adjudicated as premium processing within 15 days I thought. You may have had to do that at submission though.
Did you apply BEFORE your I-94 expired or after?
i already knew that my I94 is already overstayed..my petition was filed legally with the 180 days after the i94 has expired..i did pay for the premium processing when it was filed and still it didn't work..
can you help me with the infopass?how could i get through with my application..my agency told me that they already went to uscis and follow up my case and until now still no answer..i'm really desperate..as much as i want to get mad with the agency the answer is still in the immigration.. i don't wanna wait forever!!!!

Wow, I can't believe an agency would tell you to overstay your visa. You're going to be working as a Dietician or as a RN? That may complicates things even more for you. Good Luck
yeah and i was a fool to believe them cause i don't have any choice that time..anyways, it was done already and i have no option but to fix my problem..if the uscis will going to approve my case i will work as a dietitian and at the same time i'll apply for an RN job..i should have went home and file my h1b there..sigh:(..if worst comes to worst and i got denied i will ready face to it and go home..
