Help! Complaint Filed!

I'm hoping that someone out there can give me some advice. The facility for who I work filed a complaint to the health department. Has anyone ever had that happen? I have been nursing for 12 years and never had this happen? Please let me know thanks!!! I could use any information possible. Thanks!

Sorry but we probably need more information - if they have filed a complaint but have not given you the details then they are breaching the law of "natural justice" which is inherent in every law system deriving from the british system of justice.

I received a letter of notification from the department of health and enclosed was the complaint that the facililty had filed. I had been disciplined by the facility, it was about not following the policy and procedures set up by the facility, and was told by my director "not to worry about it" that everything had been discussed at the review board. That took place a month ago, the incident was in April. So now I get this in the mail. I thought it was over.

If the case has been discussed by a review board "in absentia" while you were absent then again they have denied you due process as they have denied you the opportunity to speak on your own behalf in your own defense.

Because I was so upset by the whole incident my superiors thought it best that I not go to the review board, so I didnt. They felt I would be too upset to answer their questions or make mistakes answering them. But I was never told by the superiors that I would be reported to the health department, now an investigation has begun!

Whether or not you would be upset is not the issue - you should have been represented at that review board as you were not then they had no right to refer the matter on without first notifying you. It sounds like you have a good case to go to a lawyer with.

no we dont have a union....this is a right to work state, so most facilities discourage it...and this is a very large facility. I have a friend who has contacted a lawyer in Tally about the situation. But I am worried about my license. I called the Investigative Services but they were vague and could not help me. I'm just very scared that I may loose my license.

I'm working on that now. This all happened so fast I didnt know what to do. I'm suppose to go back to work tomorrow. I want to ask these people about all this. Why this has happened. Could be that they are reporting it because they "have" to? I know they are protecting their butts, and not mine. I'm wondering if this is just a routine protocol.

Doesn't matter why they reported you, the report went in and you need to defend yourself. Get a lawyer, and show up at ALL of the meetings that involve your case whether they say you need to or not.
