Hello! I am a Filipino. I passed the NCLEX-RN for California already. I'm planning to go the States this April. I am wondering if getting an agency in the States is better because many says that it is better to get an agency because everything will be more easier in getting a job and the processing for changing my tourist visa status to working visa status will be more faster and some agencies do not affect the nurse's salary but instead they are paid by the hospital. I don't know if these are true! Please help me... Should I get an agency or should I go for direct hiring?

to pinoyguy, nurse dependent and himdale--you're quite a passionate bunch (now this is just a sampling of pinoys not fitting the docile, unquestioning, non-confrontational mold.). cease fire na. i hope you'll put to rest your disagreements (if you haven't yet). if it's worth anything, i felt that your posts, while they seared with emotion, revealed answers to many questions many of us readers would actually want to ask but just didn't have the chance (and perhaps the nerve) to do so. i'm referring to q's like "what-ifs" at the back of our minds.
i've been hooked to this forum because i want to learn how i'm going to find my niche in this land of greener pastures. i'm happy that i'm in good company around here.
Why is it that I am always being blamed? Issues I have explained are not just people who fall out of staus. These people are the ones who violated the U.S. Immigration and Nationality Act, who committed fraud because of having a tourist visa with immigrant intent. Well documented cases and not just friend of a friend bedtime stories.TOURISTS SHOULD NOT HAVE IMMIGRANT INTENT. THEY SHOULD NOT ADJUST STATUS TO LEGAL RESIDENT SIMPLY BECAUSE THEY SWORE TO THE U.S. CONSULATE THAT THEY WILL RETURN TO THEIR HOME COUNTRY. THIS IS IN THE U.S. IMMIGRATION AND NATIONALITY ACT. Simple as that. It is not about survival but doing it the proper and legal way so it may not hurt others who are really need of a tourist visa.
I belive that those people who uses tourists visas and then go for AOS> DOESN'T WANT TO FALL IN LINE FOR THEIR GREENCARDS. They would want to take the shortcut, the easy way out. They think that they can skip the lengthy Consular Process and earn dollars in U.S. soil not thinking that they are damaging the integrity of their home country.

At first I felt sorry for your friend, thinking that because of my post she wanted to commit suicide. But then again, you should warn her! She has suicidal tendencies. Imagine a person who want to die just because her tourist visa expired? I am not a psychologist but a simple depression would trigger her to commit suicide. What if the hospital fires her? What if she fails NCLEX? What if her heart was broken by a cute guy? And you would blame me for that?
I know alot of people hate me here but what I write is what I am. This is what I am made of. You can ban me here but people would still look for my opinion and they always shout my name. I know cause you're also a reader at murthy.com

Going through consular processing is much easy than going thru AOS from a tourist visa. No problems will arise as long you will do it right and with complete documents to present during the interview, you can get your immigratn visas easily.
If you are on a working visa, then the best way is to go thru AOS to get your green card. But on a tourist visa then it will create more problems if one is going to find an employer and work.
A classmate of mine in nursing when to the US using a tourist visa, now he is on TNT ( tago ng tago or in plain English illegal status). If someone has advise him he should not be having the problem right now. The last time I talked to him was five years ago and a year later he went to the US. He is not working as nurse but as a nursing aide because he failed to pass the NCLEX and has overstayed.
Recently, a doctor turned RN that I am covering went to the US this December on a tourist visa and now is working in a hospital in San Francisco. A classmate of him who is an immigration lawyer adviced him to go through that process.
I know there some nurses who were able to get their green cards by having to go the tourist visa way. We will consider them very lucky while the majority have to go back unless they want to be declared illegal.
If a nurse want to be an immigrant then go through the consular processsing, it is easy and not stressful.
We have our own MORAL COMPASS to guide us to what is right and wrong. And we are responsible for our actions. Peace to all.

Sorry, but the doctor, if he is working already, is doing so illegally. You must be in the US for at least 60 days before the AOS can be filed, then it takes another 60 days or so for the EAD, then the SSN# has to be obtained.

In that way, what they are doing is 100% illegal, and if they get caught, they get deported.

The doctor I mentioned is already a NCLEX passer. Went on a tourist visa and is working already per advice of a lawyer friend. It is risky and illegal. AS I said, we are responsible for our actions, he should prepare for the consequences if there are.

So he is not working as an RN, and he is working uner the table and getting paid in cash, and is in direct violation of everything. Definitely not the way to do it.

In the subject of tourist visas, AOS etc....if I could kindly ask suzanne4 for some advice. I'm an RN in my country, I am to take the NCLEX, CGFNS, IELTS and to apply for the VS soon. My fiance is also a nurse, she will be taking the local exam soon and then has plans to take the NCLEX, IELTS and apply for VS also. She has a tourist Visa. As a couple, and with her tourist visa in hand..what is our best option? Thank you very much suzanne4!

As a fiance, you will not get petitioned on her papers, but separately. As a spouse, you can be placed on her petition. But best bet is to contact an immigration attorney.

using a tourist visa to shortcut the process has its built-in complications.
and in my humble opinion, this casts a bad light to other filipinos who are applying for a tourist visa solely for touring purposes. a thin-line separates being a TNT and plans of changing your visa status at the onset.
this is flat-out unfair to hardworking, more deserving, true-blue nurses who are going through the normal motion of CP. try to ask dhel, rep, and the other nurses around here who waited years because they chose to undergo the proper and legal way.
in fact if you ask himdale, what you're planning to do constitutes visa fraud.

Actually, this is not fraud, cause an AOS is a legal process. you get an immigrant visa in two ways:either outside or inside the US. And i think, we all have our own ways of getting things done, it's just fortunate for some to have the chance to get to the US faster than the others...it is not unfair, for those "deserving-true-blue-nurses" cause, it's like youre saying that an opportunity for one is the mishap of another...

tourists should not have immigrant intent. they should not adjust status to legal resident simply because they swore to the u.s. consulate that they will return to their home country. this is in the u.s. immigration and nationality act. simple as that. it is not about survival but doing it the proper and legal way so it may not hurt others who are really need of a tourist visa.
