Hello! I am a Filipino. I passed the NCLEX-RN for California already. I'm planning to go the States this April. I am wondering if getting an agency in the States is better because many says that it is better to get an agency because everything will be more easier in getting a job and the processing for changing my tourist visa status to working visa status will be more faster and some agencies do not affect the nurse's salary but instead they are paid by the hospital. I don't know if these are true! Please help me... Should I get an agency or should I go for direct hiring?

now to the matter at hand, and to answer any eruptions that seem to be occurring here.
the issue that many have been having is not directly with the aos but not getting it before their visa expired and then they were out of status. that is where the problem arises.
yes, it is in violation of us immigration laws to go to the us on a tourist visa specifically for the purpose for finding a job and staying, however it is done all of the time by people from all over the world, and in all professions. if you are going to go ahead and go this route, some things to consider: if you file an extension, and then find a job after that application has been submitted, you will not be able to begin the process until you get an answer from immigration about your extension, as it is illegal to submit two applications of this type at the same time, and cannot be done. it is grounds to have everything immediately cancelled. if your extension is not approved, even though you have found an employer, you will be required to leave the country.
the other thing to consider is that you must be in the us for 60 days before the aos can even be filed on your behalf, then it takes about another 60 days on average before you receive the document that will permit you to work (the ead), and another week or so to get your social security number ------- so you are looking at about 4 1/2 months here without any income coming in. you will not be able to get any type of visa that will permit you to begin work right away.
if you do try to get something under the table, as we call it here, and get caught, you get deported and lose any chance of getting your green card.
so, please really do your homework before deciding that this is the route that you wish to take.

running the risk of entering into an unending exchanges of positions on the matter, i'm stating my last take on this issue.
expert positions, direct advises, opinions, and shared experiences abound in this forum. i like to think that we air our opinions (expert or otherwise) in the hopes that others gain a wider perspective on the options that are open to us all. go back to my very first post in this thread. i stated that what i said were just my personal opinions.
i realize that now, i should always put a disclaimer in my post stating the nature of the message -- ie "this is just an opinion," "or a suggestion," etc.
but with whatever people read around here, it's still up to the "reader to decide." (borrowing your own words, my friend). at the end of the day, people are (dare i say, should be) responsible for their actions based on their decisions, whether these were derived from an expert advise, from a quasi-expert, or a mere thought-sharer.
my wife and i have very personal reasons why we chose the cp route instead of the aos. to humor you, these are our topline considerations: practicality, official and personal responsibilities, and fairness. i sincerely hope that you accept those as the truth.
if my post caused a negative effect on your friend and her daughter, please extend my sincerest apologies to them. it was never my intention to do so. good luck to her. she's lucky to have a friend like you.
even if i don't agree with some of your points, please believe that i am still respecting your opinions. remember that. i wish you good luck.

the sad fact of the matter is that we live in a country where we are left to fend for ourselves. no amount of personal sacrifices and hardwork will yield positive results for our family, and for our country. you're right. word of the day seems to be survival. i hope you believe me that there are people who still consider even a tinny bit of national sensitivity in that equation.

as what pinoy guy shared with us, our words have an effect on each other. my personal suggestion is that, let us not stop getting whatever kind of information regarding this matter. keep posting. let's keep ourselves informed. let's continue to ask questions. in the end, put a premium on expert advise by consultants, your agents, or immigration lawyers. some opinions around here may not sit well with you, ask them about it.let them validate or debunk.
then that's when we make the decision that we feel is right for us. let's try not to assign blame on each other if we make a wrong turn. let's try to be responsible for own decisions as well. these are our actions. our individual lives. our individual future.

Anyway, it's amazing how many people still think that everything they read on the Internet is true. Some of the people I advise come from the provinces, and are relatively innocent regarding the Internet.
When I learned that she had let her visa expire, she said "Nasa Internet e, makukulong daw ako." ("It was on the Internet, I will get jailed.") When she showed me this (and another) forum, I was aghast.

Well, I have been entertained by an exchanged of ideas.
This nurses' forum have helped me a lot. The thing is research and reseach so we are not in a blind and share your knowledge/opinions so that others may know. Your opinion can influence a lot of poeple. But it is up for them to decide. All of us who posted here have no intention to mislead others and cause them harm, our posts serve as warnings/guides to others who are uninfromed/misinformed.

again, these are issues with people that fall out of status, but that is not the norm, fortunately. if they have done their homework, there is absolutely no reason for anyone to fall from status in doing things correctly.
each of you are entitled to your own opinions, but in no way will this forum be used for arguing with each other. personal attacks are not going to be accepted here. and just as a warning, it could ultimately lead to banning from this site by the administrators here. we do not permit it anywhere else here, and definitely not on this site.
each person is entitled to make their own decisions on what is best for them, there is no reason to insist that one way is the only correct way.

if i may respectfully add to this (with your permission, of course), if we do decide to listen to an advise (expert or otherwise) or an opinion, let us also refrain from assigning blame on other people should the consideration of the opinion turn out to be counter-productive to our individual objectives.
the course we eventually choose to take should be based on careful considerations of so many things, definitely and should be beyond the personal interpretation on a matter by an individual.
whether an information is useful, irrelevant, or even disturbing for you, careful scrutiny and validation by a subject matter expert is strongly suggested.
as suzanne stated, decisions are made by an individual based on what they deem is best for them. we should be responsible too for the consequences of the decisions we make.
bottomline, we all want to keep this forum as productive as it is intended to be.
