Hi, please help me decide. I am an ICU nurse in the Philippines and I have an agency who filed my EB3 visa last year.I have signed a contract with them. Now I have found a direct hire position in the US they know that I am under contract with other agency but they still want to hire me. I am thinking of getting out of the agency because I think direct hire is better than with the agency. Can I still get out of the agency? I know it's a breach of contract. What are the possible way for them to help me get out of the agency? Which one do you think is better, under agency or direct hire position?

If you have a job offer in the states, I think it's a bit much to ask them to help you get out of your previous agency obligation. There are not many areas in the US that are in dire need of nurses; therefore, not many employers are willing to pay hiring bonuses or contract buy-outs.

Its probably a nursing agency. Meaning you get contracted out to a hospital but the agency pays you and the hospital pays the agency.
Hospitals obtain the services of agencies because it is expensive to recruit a foreign nurse to come to the US on a greencard. So the agency does this for them. If the hospital no longer needs your services, they are not obliged to keep you as they don't actually employ you, your agency does. Your agency will then need to find another hospital for you.
It is fairly common practice in the states owing to the cost associated with emigrating a nurse and the unpredictability of the healthcare sector.

I wonder what's an update with your decision. If I had that offer, I will choose direct hire and get a professional legal advise on what to do with the agency. I recently pass my NCLEX-RN exams and now actively seeking for a job in US. Could you please share your experience on how have you arrived to getting a direct hire employer. Would be much appreciated.
