Try to contact the board,if possible, ask for an appointment and go directly to the board's office, talk to your licensing analyst or whoever is in the position to talk about your case.I hope you will get through with this..Good luck:)

This is something we really can not answer as the BON will make their own decision based on information provided

TO the OP: I remember your previous posting, but I think you left out ONE very important thing that you did NOT disclose to this current thread and the other posters here and please correct me if I'm wrong.

But didn't you attend a hearing and you pleaded "Guilty" in front of them? If so then you by your own admission, you are guilty as charged. If that's the case, it's like saying you stole the diamond ring, then again, you really didn't.

You need to disclose this fact, if it's true what you said in that hearing.

Is there something else that you have not mentioned as well besides the Guilty pleading?

However, if I am wrong, I do apologize, sorry, but if I'm right in my comments, then it's going to be very difficult to go back on your "word of honor".

Step, srry about the guilty part, this is the reason why i made a new one because i couldn't edit the that part on my previous page, actually theres 2 box. one for Re appeal and they will check it every 2 months, the 2nd box is Cancel the test and the appeal , and they will immediately begin the process, and to make a decision whether they'll let me retake a test or never/suspension..

You're guilty of examination fraud by your own admission. On most state's licensure applications you sign an affidavit stating that you understand that the Board of Nursing can deny your application for licensure for a list of reasons one of the reasons being examination fraud. Using a phone during an examination is a pretty BIG deal. You are basically at the mercy of your states board of nursing now. That you passed an NCLEX examination later is irrelevant.

I can request for hearing within 60 days and after 60 days my right for hearing will be deemed waived and request to wait one year before reapplying for licensure.

If I were in your shoes, I would request a hearing before the 60 days is up, and I would hire an attorney to represent me. I wouldn't assume that if they tell you to wait a year to reapply that that means your re-application will definitely be accepted -- it might not be. Better to address the issue head on by getting your BRN to make a ruling on it.

That's my $0.02. Good luck!

Boy, you guys are way ahead of me in understanding this poster's issues. I can barely read it. OP, if you really did plead guilty at one hearing, (perhaps because of a language barrier?), you have to live c that. Good luck in your future.

The best and ONLY way to solve your situation is to work directly with your BON. Sadly, no amount of advice on this board can help solve your issue. Hiring a lawyer may also be to your advantage. Going forward, make NO assumptions and get everything in writing from your BON. You are literally at their mercy at this point. Hope things turn out favorably. Good luck!

As stated on NCSBN website: https://www.ncsbn.org/1268.htm

NCSBN may cancel or withhold your results if there is a basis to question the validity of the results for any reason, notwithstanding the lack of any evidence of your personal involvement in irregular activities and/or for your failure to adhere to the Confidentiality Agreement. Evidence of invalid results may include, but are not limited to, unusual response patterns, unusual score increases from one exam to another, failure to obey exam administration rules, or observed irregular behavior.

NCSBN reserves the right to cancel or withhold any test results when, in its judgment, a testing irregularity occurs; there is an apparent discrepancy in, or falsification of, a test-taker’s identification; a test-taker engages in misconduct, or irregular behavior, or violates NCLEX Examination Candidate Rules.

Ok, I found your previous posting back on Sept. 27th, here's what you wrote:

"pls help me on this one, i took my 3x first was nov of 2011 my test was cancelled bcoz i used my phone so then they send me a letter to appeal, after sending them my appeal they did not approve it, it says i can re appeal again and they will check it every 2 months or just plea guilty, i didnt want to wait that long so i plead guilty and after couple of weeks i recieved re examination. So the 2nd one i failed recieved a bad pop up so they send me another rexamination i took my test july 21,2012 and got the good pop up for 2months of waiting. And i got a letter today saying denial of application for licensure because of what happen on nov 21,2011. I can request for hearing within 60 days after 60 days my right for hearing will be deemed waived and request to wait one year before reapplying for licensure. I don't get it,before they send me a re examination wouldn't they review my records and application? it's killing me guys i hope you guys can give me an advice thanks!"

-- Back then, you stated ".... i didnt want to wait that long so i plead guilty and after couple of weeks i recieved re examination."

-- Just for the record, did you in fact "plead guilty" OR did you mean you just checked off the wrong box as you mentioned in this new thread?

Just so that the readers can get a better grip of what's actually happened is why I brought this up and now as others have suggested, I do agree with the thoughts of hiring a lawyer to better represent yourself.

I'm sure your lawyer will understand the legalities of this situation as I think you may become too emotionally involved and can give the wrong answer or incorrect wording that you didn't mean to say, but under the microscope, you may feel too much pressure, break under that pressure and say the wrong thing.

Good luck!

Hey steppe I appreciate ur reply, i found the letter it doesn't say guilty it says cancel appeal or re appeal ,then it says the board will immediately begin the process, when they received my letter they gave me another later stating that they received my cancellation of my appeal therefor the ncsbn will cancel my test for, also it says pls note that if I apply to take the test the board then will be notified that I have violated the policy and then they will have to deny my application. So basically I thought I was going to be suspended but I wasn't sure because I didn't get any letter of their decision, Instead I got a reexamination application which then I was able to take the test twice, but going back to what the board said that if I apply the board will be notified and I wil be deny to take the test, since my application went thru twice I assumed that they cleared me out.. By the way they did not accept my reckoning date instead they accepted my hearing, I don't believe I need a lawyer because i just want to know what really happen that i was able to take the test and how the system works...and if they tell me that they made a mistake and I have to be suspended then there's nothing I can do.

In my state, our laws stated that the Board may deny licensure which means............they cannot stop you from taking the test but they can stop you from getting licensed. I believe most states operate this way also. ***this is not for new licensee's and is completely different than those who had their actual license revoked and having to retake the exam.

Did they let you take the test again?
