Can a hospital retract their job offer

I was offered a new grad night shift position in writing at a Hospital in Maryland. I did all my requirements even a physical. Dring the physical the nurse decided that she thought something was wrong with my neck and I had to go see a doc about it. I had to pay out of pocket cost to go and see a doc when I made it clear that I was fine ( . The results came back that I was fine. I purchased my uniform and was getting ready to start orientation this Monday. I got a call from the nursing recruiter saying that management decided not to offer this position any longer. My start date was one month for the position and now all other positions are gone. What can I do I am at a lost. There was no reasonable explanation given except we no longer offer this position. I still have my uniform which I payed for. I signed all the paperwork included how much I would be payed etc ( would that amount to a contract

Wow ,I am sorry you got that impression . My only intention was to garner information not seek compensation . Since all new grad positions are gone for most of the hospitals in Maryland .I decided to look a regular job at a restaurant. I was not even thinking along those lines. I asked several questions as to understand what amounted to a contracted since my understanding was different because i had prior paralegal experience. Yes I am returning the uniform. I am some what out of pocket for the shipping charges but I will bear the lost.

There are seriously no home health companies, private duty spots, nursing homes, hospices, group homes, jails, prisons or psychiatric facilities that hire new nurses in Maryland? The exalted acute care hospital is not the only gig for new nurses.

Non-hospital nursing position = RN pay + RN experience

Non-nursing restaurant job = Low pay + Zero RN experience

As "right to work" becomes the loophole by which nurses are let go up to and any time after working, this can be very common. And scary to say the least.

What physical? If you were told to go for a physical it was a post-hire physical, a contingent physical. The results of the physical could cost you your job only if you could not perform the essential functions of your job considering reasonable accommodations.

In short: Once you are sent for a physical you are considered hired unless you fail which you did not do.

There could be both state and federal laws to consider. Employers covered under the federal American's with Disabilities Act (ADA) may only require a physical examination after a contingent offer of employment has been made. Your state may have additional requirements for the employer.

Double short: You were hired. You were sent for a physical. You met the essential functions of the job.

Triple short: For most employers of any size there is no such thing as a requisite pre-hire physical. You appear to have a valid ADA complaint. To file one see:

The ADA people can be real bulldogs—go for it.

But if the employer stated they eliminated the position, as well as other positions, there is no ADA claim. If they had said the candidate lost the offer because of the neck issue then they might have a case...

In responce to your answer I have sent out numerous applications. I don't have a car(take bus) so I have limited options. Secondly, I have loans to pay which by the way became due this month without any warning and I had been on top of that. So for me I have to be proactive and seek gainful employment until a nursing opportunity comes along. I waited one month after signing all the paper work, doing my physical , taking my ID pic, taking the maths test and passing it etc for them to rescind that offer and I am not going to be that foolish again. Let me clarify the neck issue I did the physical at the Occupational health at the hospital and my neck appeared swollen to the nurse. She told me that I had to go to my own doctor and get a blood test and ultrasound to show that there everything was okay which it was. I had to pay out of pocket for this as well. ( I presently don't have insurance without getting into my life story and I am not qualified to get it and I know this is going to open up a can of worms and speculation) So for me that was an additional cost. Posting on this form i wanted to know if persons had similar experiences and at that point I was feeling down and needed encouragement.

There is not a nursing home within a bus route? Or at least Uber?

If you can not pay for student loans you can always defer payments while paying on interest.

You know, everybody here seems to just want to help you. It's true we don't know the entire story but that isn't our fault. People are just offering suggestions. It's easy to become blind to our options when we are dealing with a great disappointment. All of us have been in that place in some form or fashion. I think your saltiness is misplaced.

Honestly, I am not salty neither am I bitter or angry or none of the above. If you noticced in my previous post I thank people for their opinions. By posting on this forum I knew what I was getting into. I knew that people are going to say what they want (good/bad) . If I wasn't able to handle critiism I would not be where am I today.

I saw one post very early on and then another thanking a specific poster while indicating that you felt the rest of us were being insensitive (there was a post that pointed that out to you which you seem to have missed or ignored). The quip about it being easy to tell you what to do without knowing the big picture was the saltiness I was referring to. Really, people here are generally very willing to commiserate and problem solve with you. That's kind of what nurses are wired to do. Take their advice or leave it but don't criticize it. As a new grad you would be wise to pay heed to what we are saying. Many of us have decades of experience under our belts and very likely have actually been in your shoes. In the future if you aren't ready to hear advice it might be best to just let people know you are ranting and aren't emotionally ready to approach the subject rationally (although I'm not calling you irrational) but instead just want to vent and move on.
