Agencies and contracts

Please pay attention to your contract before signing it. There is no such thing as a free green card. The money for it will be coming from your pocket, not the agencies. In most cases, there is about $5 per hour taken from you to cover the expenses. This works out to about $20,000 over two years. Expenses are about $4,000. You do the math.

The better way to do things, if you can afford it, is for you to pay the fees, and then you are in control, and can pick your attorney, etc. The facilities are normally paying a relocation fee that will cover your expenses.

Also, pay attention to what the cancellation fee is. If for some reason that you would need to leave your contract early, or the facility cancels you, you will be responsible for paying that fee. The document that you sign is a legally binding contract. And some contracts can be as high as $15,000 to $20,000.

If your recruiter makes a promise, but it is not written into your contract, then it doesn't exist. It must be in writing and signed off by the management of the agency. And oral promise will not mean anything, especially if your recruiter is no longer working for that agency later on.

Hello everyone.

I would like to ask what happens next after the approval of I-140 going thru Packet 3. Will my agency need to pay the visa processing fee outright or NVC will send the Packet 3 to them and then pay for the corresponding fees? And how long on the average does it take for the NVC to process Packet 3? Any input will be greatly appreciated.

Thank you very much.

The fee has to be paid first and then the next packet will be sent out :)

hello suzanne, I passed my nclex CABON already. Would you suggest any agency? Or do you know where can I find hospitals who would hire international nurses directly. Thanks.

Which country are you from? Have you taken the English exams? Where in CA do you wish to work? Which specialty? did you apply for the Visa Screen Certificate yet?

Do you have any experience in your country as an RN? If so, how many years?

I am from the Philippines, graduate of April 2004. I have six months hospital experience in ICU/CCU in a 300 bed hospital capacity. I will start reviewin for IELTS this Jan. 3. I have applied for visascreen but I am still fixing my problem with my birthdate. I have applied for an online account for CGFNS/Visascreen but after creating my account, my birthdate showed April instead of May. I am thinking of creatin another account since I have not passed any forms yet other than my application form.

I plan to work in California. Do you have any suggestions?

dear suzanne,

thanks for the advice regarding the agencies!! I know I could count on you !!! there's just some things that keeps bugging me like what will happen to my green card status if in case i dont finish my two 2 year contract with the hospital facility? can immigration take back my green card and deport me home? or can another facility take me instead? will I be out of status? i'm now here in texas!!! Thanks a lot!!! :chuckle

Nothing will happen to your green card, it will be yours and you will not get deported home, BUT you will be responsible for the buy-out or cancellation clause of your contract. And with some agencies that can be about $20,000 US. So pease, read the fine-print closely. And if it sounds too good to be true, it probably is. And if it isn't written in the contract, it doesn't exist.

The only obstacle in changing an employer is the buy out fee. You can change the employer even during your immigration process if your petition is pending for more than 180 days. Immigration law allows you to work for the same employer in another facility or change the employer but work in the same or similar occupation. BUT if u have signed a contract you have to either complete your course or pay the fee(If there is any):) .

unfortunately, I got the contract with all the bad things susan mentioned above. They didn't tell us where to go and how much they would pay. Actually, they changed their contract during the immigration process. I first signed the contract with a hospital in Toledo which I was very interested in. But the agency asked us to sign another contract with them changed their job offer. I didn't know anything about my employer at that time. They threatened me that if I wouldn't sign the new one, they would cancel my immigration application. I signed the new one, with 25,000$ cancellation fee. I am now here in Detroit, far away from my family...

That is why it is so important to read the fine print of each and every contract.
