I am currently an LVN at this time but I just got accepted into the RN program to start in August 2018. A year and a half ago December 2016 I got arrested for a DWI and have still not went to court. This is my first DWI and it is a misdemeanor. MY LVN license is still active and I am working. I do not need to renew until October. But I was informed I would need the BON to approve give me my authorization to test (ATT) for my RN NCLEX before I can start the program. Has anyone ever experienced this before? I have no conviction and no convictions on my record. Do you think the BON will give me the approval in order for me to start the RN program in August? I am so worried! I don't even have a court date yet!

I don't think the BON has any part in approving you for school. The school will be the one running a background check. I don't see how they (BON) would grant you an ATT when you haven't even started school yet. That doesn't make much sense. Maybe your state is "weird", though.

What the BON can do is prevent you from sitting for boards, offer you an RN license with stipulations, or not allow you an RN license at all.

You may be required to report your legal difficulties to the BON when you renew your LVN license, too ...or even before then, I'd check your state's site and see what it says.

The BON in Texas does approve students upon enrollment. I'm not 100% how it works, but I do know it i mandatory. So submit the form an go from there.

Is that just for LVN to RN? I went to school in Texas, but it was straight RN and eight years ago. I never dealt with the BON until after graduation.

I think it is recent. But I know it can impact admissions.

Worrying about it won't change anything. Move forward with your process and see what pops up...if anything.

They said they run a background with the BON before we start because if they have any issues with what is on our background it is pointless for them to put us through the program if we aren't able to take the NCLEX.

It is for RN or LVN-RN which I am doing. They are sending our info to the BON prior to starting to make sure we pass their background checks.

Wow ....that's actually pretty terrific for situations like this one. In a lot of places, you only find out if you'll be allowed to sit for boards after completing the program. I'm guessing they could revoke permission if something new happens, though.

I kind of like that idea actually. Certainly better than going through a 2-4 program just to find out when you are done that all that time and money was wasted because you can't take the NCLEX

They did not used to do that. I think it is great that they do now.

When you fill out an application for a license you will need to disclose this type of legal trouble and it can indeed impact your ability to be licensed. In addition to your school, what shows up on your background check can also impact whether a given hospital or other entity will allow you to do clinical rotations in their institution. It would probably be in your best interest to sit down with the Dean at your accepted school and self disclose what is going on and find out what impact it will have on your future with the program.
