Recently, I was arrested for dui in florida, was in the car in the parking lot in front of a restaurant with attempt to call friend to pick me up, wasn't even driving. What I should do about Florida BON, I have a lawyer for DUI, not for the board, and how it may affect my license renewal? Please, if possible for you guys, don't dive me advice about drinking habbits, I am drinking socially like a lot of people do,never drunk and drive and I am 45 years old and have been practicing nursing for more than 2o years, so nursingt is my life. So, please if anyone had similar experience, i would like the practical advice. Thank you so much in advance.

Everythning should be based on reason, situation, and humanity. If this cop would be reasonable so he would be listen, assess the situation, and made a right reasonable desicion, such as waiting wor the cab or one of my friends arrived to pick me up, that what I would do. Is it sound familiar in nursing when we are making desicion about patient care?

Unfortunately, the "mean cop" was just doing his job. It is a law in Florida that you can be arrested for DUI while in the drivers seat - even if you never put the key in the ignition.

that is strange that it is called "DRIVING UNDER THE INFLUENCE" when the person is not literally driving but sitting with the phone in her hands to call for someone to pick her up.

I never said it wasn't bad luck. Unfortunately, I know I don't draft the laws. I most certainly am not saying that the officer was correct in terms of using his/her better judgment. Like all professions, there are those who approach it with care and conscience and those who are, for lack of a better word, complete shmucks.

I have had a DUI 12 years ago with property damage and leaving the scene of an accident ( went to call the ambulance). It has cost me dearly. I wanted to go to law school and was turned down by all of them. I tried to enter a career in law enforcement and was turned down by all of them. I can not even get a job as a pizza delivery driver due to insurance reasons even though I am a safe driver again. I recently applied for admission to take my RN license and the BON of Florida turned me down too. I hired a lawyer but it did not go anywhere. The BON can make its decision discretionary, it reserved a gray area where they can turn down anybody if they want to. It is nowhere spelled out in the Florida Statutes or rules that it will exclude you but it also does not say it will allow to become an RN. I contacted all law schools prior applying and they all stated it does not necessary exclude me but after I applied and $1500 later on application fees I was turned down by all of them. Now, I contacted the BON before entering Nursing school and tried to pry out information but it was always the same "should" not exclude you "but" the Board decides. Needless to say I am drowning in student loan debts (BA Degree, AS Degree Nursing) but can not find any decent employment. I am not looking for sympathy, I admit to having made this mistake years ago and his literally destroyed me for good. Education is no protection. I have decided to leave the US and use my Nursing education elsewhere. So, I hope this helped somewhat. What I am trying to say is it is a difficult and costly decision to make. My lawyer got this much info out of the BOB, that years ago it may have been a different story but with so many people applying for an RN license they can pick and chose the best suitable candidates. :sniff: Oh my. I know you're not looking for sympathy but after reading your post I just can't move on without at least giving you a hug.:hug:I'll keep you in my prayers and I'm so sorry for your struggles. Hopefully you will overcome and turn out to be a terrific RN.

BTW, do you think their decision is a result of the new Florida statues concerning time limits? Maybe you can reapply after the time limits are up if that is indeed the case.

Thank you for your response, no I am not re applying this struggle has been going on for 12 years now and I am 41 years old so it is also an age issue.

Just out of curiosity, did you ever try to Expunge your record after 5 years?

Had a dui before nursing school and it was a pain dealing with the board just to get my license.Most states when renewing your license ask if you have any charges. The board probably would want you to get a drug/alcohol eval to make sure you don't have a problem. Good Luck

I think that is a case that only the court will give judgement. better look for an attorney.
