Someone please advise me on this issue..

I took my test 2 weeks ago and my results were on hold... I received a letter from pearsonvue that they will have to cancel my test because I violated a law by using cell phone.. They gave me an option to appeal..

They are right, i used my cell phone on my way to rest room.. Not inside the exam room.. My 12 month baby is in another country and he went to emergency due to illness.. I callled my hus for 10 seconds on my way to rest room to check and see whether he got calls from the doctor.. While I was in the phone, examiner came out side the hallway and told me to hang up the phone and I did rightway and told her that my baby is sick and i was checking with my husband and she said it ok dont call again and I did not..

On the next day of the exam I had to flew back to my country in an emergency ticket and just came back today.. I have the ticket copy showing the nextday afterwards travel date and stamped passport.. Dose anyone think i can appeal with the info..? I can get the medical certificate from the hospital showing that my baby was on the hospital on the same day i was taking test.

I made the call due to anxiety.. When my baby was only 4 months i send him to my parents house just for me to prepare the RN exam and he was staying there for last 8 months.. i did so much hard word to prepare the exam... I have the local country police certificate aswell showing my baby was there for last 8 months..

Please please guide me what to do in this case... I couldnt even sleep.. I used it on my way to rest room and the examiner confirmed it is ok.. I had 265 questions and took 6 hrs to finish and i was the only one in the room after 6.00pm, so i may be the examiner got mad.. however i am really confused, i have the Appeal or No Appeal letter from pearsonvue...

I feel so sorry for you. This was obviously a very trying time for you. By all means state exactly what happened and provide the proof. You might want to get someone to read over your appeal before you submit it to check for completeness, errors, and clarity. And be certain to send it certified mail, return receipt requested so you can trace it. Best wishes.

Honestly I would also see if you can get a thing from the phone company showing how long your call was and who it was too. They may ignore it but if you give them a good picture of what happened then it might help. So sorry to hear this happened and praying for good news from you in the future!

I'm sorry my dear but the exact same thing happened to my friend, she ended up getting a lawyer to write a statement for her to send to BRN but then they ended up replying that they need to review the case and keep sending letters making her wait. they were deciding if she would still be allowed to take RN exams in the future because of her record using the phone. So she decided to just write them and said that she is willing to dismiss the test that she took and just let retest again than being block listed and they approved it but it would be on ehr records.

I think this would be very hard to appeal since (at least at my test center) you had to read and agree to the rules, which clearly stated no phone use at any time - including rest room breaks.

They were very specific about the rules when we went today to test. I think I would explain the situation and then ask to retest.

I appelead on Pearsonvue however they denied so I told them to cancel my exam results and reauthorize me... While I did that i send a re-application to nursing board aswell..

Now nursing board send me a letter, denied my application and here is the two options they gave..

As an alternate of formal hearing, it may be possible to reach an agreement with the board. Under such an agreement or stipulation, the board will issue a license on a revoked status.. The revocation would be stayed (i.e held up) and you would be placed on probationary status........ """"""""""""

I wonder what they mean by hearing and revoked license, is that mean I passed and they want to gave revoked licenese or suspending my RN carrier to write another exam...? If I get revoked license from California board, can I work on any other states which is different boards..

Please give me some advise.. I am really not clear on what they mean.. I am really depressed.. Is this my end of my medical carrier.. I have huge students loan i took for my RN studies, if io can never write RN exam again i will be screwed.. ..

Please seek the advice of an attorney. They are offering you the difference between an execution style shot to the head, and a shot to your torso with no medical care afterwards, so your death is slow and painful. Either way, not good and not what you want. Please talk to an attorney. Having an attorney on your side might make the difference between getting a free and clear license and not getting one at all. A tainted license may be worth next to nothing, and you don't need that if it can be avoided. Remember that if you seek work outside of nursing, there may be times when you are asked to disclose the fact that your professional license (any professional license) has been tarnished. So it is possibly not just nursing where you won't be able to work. None of this matches your transgression. Best wishes.
