I work in this long term care facility that really needs to be closed down. I find it very hard to believe that it is even still opened. The DON and Administrator have an attitude of tolerance for abuse. I have previously given them written reprimands for CNAs for verbal abuse and neglect, cursing residents and even roughing them up with care. They still continue to allow them to work. I even gave the Administrator notice that stated for her to ask me to work with a particular CNA is to ask me to tolerate abuse; the CNA came right back to work. I have reached my breaking point. I advised them that recently I worked with a nurse who was asleep for at least 5 hours during her shift and failed to give a resident an IV ABT and another one tube feedings. They pretended to investigate and then let the nurse come right back to work. When I spoke with the CNA staff that was present that night two of the three told me that no one had asked them any questions concerning the nurse because they would have gladly reported her as this is something she does every single night she works. The third CNA I never got to question but she would most certainly lie for the nurse. She is also notorious for sleeping and a very close friend to the nurse.

This nurse actually has 2 other jobs and often times she is scheduled to work 56 hours in a row, non-stop with only 3 hours left for eating, showering and traveling back and forth to work. She actually brags that this nursing home is where she sleeps. I have reported this nurses behavior in the past and it is falling on death ears. I even reported that she worked in a facility 3PM-11pm on the very days that she was scheduled to work at our facility 7PM-7AM; she would take her lunch break from the other facility and come to count narc and get report, hang around for an half an hour pretending to give medications and then leave to go close her other shift out at the other nursing home.

Well now I am feed up!:angryfire And I advised them that since they refuse to address my concerns that I would report the nurse to the professional licensing board. I did just that in an official complaint. I also filed an official complaint with the corporate headquarters of the company. Within 24 hrs of my complaint they sent three representatives from corporate to talk to me. But I really think they are only seeking to minimize the company's liability and have no genuine interest in what is going on in the facility. I am at my wits end as to what to so. I really think the relationship that the state ombudsman have with the management of the facility is less than professional and she works really hard to make sure their complaints are unsubstantiated.

I would like to know if anyone knows any federal investigators or who one would contact to investigate gross neglect and abuse in nursing home. There are so many incidents of abuse in this place, that is is frightening, Nurses routinely don't give medications and patients are sent out to the hospital with grand mal seizures only to have very low levels of Dilantin and Valporic acid med. We even had a Dr. to call us on the weekend in the wee hours of the night and insisted he speak with an administrator then and there. I had to give him her home phone number. The next day or so the unit manager and DON went on the medication cart and removed a large number of medication from the cart that was dated at least two and three months previous and put them in large garbage bag. This was definitive proof that the nurses were not administering the meds but they just covered it up. I think the nurses were give a suspension for one day.

I am so furious:angryfire And this has to stop. I am sure I have cost myself my job but I really don't care. If they take me off the schedule then I will probably file a law suit. I just have to find the right attorney for the case.

Ps I Hope You Have Copies Of Your Letters To These So Called Higher Ups. 2- If Meds Were Not Given And Xtras Left Then Proof Will Be Of Refill Dates, Pharmacy Can Provide That To The State And Low Serum Levels.

Dns Hung Around And Waited For The Sun To Come Up And All To Rise. Said Nada. Waited...when Pca Woke Story Goes She Was Walking Around With Her X Mark. Dns Told Her To Go Look At Her Face In The Br. Pca Was Not Even Aware. Dns Pulled Out Her Tube Of Lipstick, Told Stunned Pca Then And There...you Are Fired. Fixed Their Wagons. No Union To Back This One Up. Oh Boy What A Move This Put Under Some. They Were The Good Old Days.

This sounds like a very difficult situation to be in. I am sad for you having to work under these conditions and I fear for YOUR license if you continude to allow the negligent CNAs to work under your supervision. Even if you requested the CNA not work with you, if you took those keys and command of that floor then you ARE responsible for the aides actions and it can come back to bite you. Facilities are not our friends. You may want to consult a lawyer just to be safe. Call your carrier and get some advice. I know YOU did nothing wrong but I've seen in the past the person blowing the whistle was also the person the facility pointed their fingers at. They may be especially bitter if they are dropping the ball in other areas that will certainly be investigated when State shows up. Retribution is a witch.

yes, it would be a much easier way out, to just walk away.

then there are those who walk the walk and do everything humanly possibly, often at the expense of their own jobs.

What do the families think of the care? I'm sure alot of them are not happy either. Are there any other employees like you that are sick of this?

That's the first thing I thought of, because if I ever found out that one of my loved ones was being mistreated, you can bet that there would be h*ll to pay!

Make sure you have copies of everything - letters you have sent, even pictures of the extra meds or whatever. You're absolutely doing the right thing, but you're going to have to cover yourself - the facility will most likely come after you. Make sure that you have absolute proof of what is going on, and proof that you have complained and nothing has been done. Get your coworkers/docs on board as well - the bigger the group of "complainers", the more attention you will get. Good luck! These residents deserve a safe place to live, and it doesn't even sound like they are getting bare minimum of what they are paying for!!! I don't know if you have talked to any of your coworkers about this, but I'm sure you can't possibly be the only one who feels this way! You should talk to the doc who always wants to talk to the DN or whoever...I bet not only would he be on your side, but he might know a better way to get things done. I know it's the facility that is causing these problems, but it's his pts and his insurance as well! By the way, your official complaints should probably be about the facility itself rather than individuals - you can always point them out later if necessary. Consult a lawyer if you can't get anyone else to listen. I'm sure they would be able to help you a lot more than we can!

Call the DSS (Department of Social Services) and report Elder Abuse. You are a mandated reported if elder abuse is occurring and at least in Massachusetts it is the same as Child Abuse.

i'll share what saved me when i did this yrs ago...

it wasn't ltc but still, new director and DON had taken over.

also facility was bought by an out of state company.

what was going on at the facility, sickened me.

all concerns fell on deaf and seemingly, hostile ears.

for yrs i had a flawless record.

suddenly a paper trail was being created on me.

what mgmt didn't know, is that i had been emailing corporate since they took over, voicing my concerns.

i also predicted (correctly) that i was being sabotaged by dir and don.

i got the state involved and a HUGE stink was made, w/the facility nearly losing its accreditation.

a month later i was terminated after sev'l yrs of service.

i found a nurse atty and sued for wrongful termination.

once the atty saw all the documentation (emails et al) i had collected, with concerned and validating responses from corporate, she took my case on contigency!

that's how confident she was in us winning the case.

yes, i lost 'friends'.

funny how they go running back into the woodwork.

and eventually we settled.

director, don both lost their jobs.

don and nm were also charged by BON.

and corp ended up selling the facility.

i'll tell you, it beat the crap out of me.

doing what you know is right, has never felt so wrong.

and i actually questioned whether i would do it again, protecting those who need it.

yes i would.

i know that now.

and i have stepped up to the plate since then...

actually, a few times.

but since i became somewhat of a known figure around here, no one messed with me.

and our pts got the attention that was so lacking...

as well as some top dogs being fired or losing privileges.

if you persist with this, i strongly recommend not stooping to anyone's level.

and people will play dirty...downright filthy.

remain objective, stick to the facts and everything (i mean, everything!) in writing.

jot down names of everyone you talk to, even if it's a secretary/receptionist.

dates, times, circumstances.

do not talk about this with any of your coworkers.

truly, your reputation is on the line.

you want to be able to carry this out with your head up high.

Someone needed to 'sic' the state on these people, and I'm glad you did. And the state BON needs to get an earful.

Strictly patient care issues aside, once your administrator was informed that residents were being "cursed at and roughed up", that administrator had an immediate OBLIGATION to report that abuse to one or more agencies. If that didn't happen, it's reallllllllllly gonna hit the fan for all concerned now.

My advice: Don't be around for the splatter.

wow. i'm proud of you for standing up to do the right thing. i probably wouldn't have been able to stick it out as long as you have after seeing little to no response from the previous complaints but you are terrific!

maybe somehow those poor people will get the care they deserve!

I'm still a student, but wouldn't it be our responsibility to speak up repeatedly until someone listens? I know that nobody wants to work in a bad environment, but I would hate to think that being a patient advocate in an environment where there are no other "friends" to the patients would put US in peril instead of the trouble makers. How is anyone supposed to be held to task on unsafe behavior if every time something bad is happening the "good nurses" bail like rats off a sinking ship?

I'm not trying to stir trouble or anything. I just don't understand how leaving would be the best choice? Is losing our license really so easily possible that we have to think of that before thinking of helping patients in need of an advocate?

I understand all points here. Someone had to speak up. The patients need an advocate. However, the OP needs to be protected and has to eat/support self and family as well. These people may go as far as to bring up trumped charges on her/him making it difficult to work elsewhere...especially if it is a small town. Seriously, though, I'd start looking for something else TODAY. It is easy to be blackballed to lose your livelihood if you have a person (even moreso with a group of people) whose backs are against a wall and have their own interests to protect. Many times, unfortunately, those who are the troublemakers remain until retirement while those that care may even cut retirement short because they are physically and mentally beat to the bare bone.

You need to get away from that place. Please redirect some of your energy to looking for a new job before you harm your mental health. The less energy you invest in this hell hole, the less chance that you will make yourself sick over things that you can not change. You can change whether or not you continue to work there. Get a new job, and resign. Do this, if possible, before you are fired. Then, only devote as much time to dealing with past issues, as is practical, considering you will be getting acclimated to a new workplace. Good luck.

These are sites that list the appropriate agency to report nursing home violations to. The Dept of regulation and licensing is the agency that deals with licensing of nurses and other professional but does not take complaints or reports that pertain to nursing home regulation.

I'm still in litigation 3 years after I'm was terminated for whistle blowing, got good lawyers and am being as patient as I can be. It's a long road, and those of us who have taken it have paid a price for it, I personally have not regretted it.
