No, she's saying that by using the word "caught" the OP is already saying that the guy didn't possess something legally. you can't be "caught" doing something legal, that's the point.

I'm not suggesting that ...the opposite, actually. Nobody gets "caught" with Tylenol. "Caught" implies wrongdoing of some sort.
