I was working in an asst living facility. Many neglected pts & ppl in w/c? Lol. Asst living. On my eve shift I was alone nurse w on cna. One pt was 2 ppl asst by admin orders dt over 300 falls, yes 300. The man takes bp pills, trazadone and drinks alcohol. Well no one told me my cna was not allowed to touch him dt recent issues & cna suspended over abuse of same pt. I tried to take pt to BR but we both almost fell. I already worried about license & getting into trouble over these so called asst lvg pts who are nursing home but no help there. I call the DON she tells me too bad. I'm 20 min away. U have to wait for next shift. I has the pt with me to prove I was trying to get help. He was in his usual boxers. We were in room alone. He never complained to me as we sat there tgtr waiting for help. I actually apologized to him. Admin said I am turned in for abuse cuz the way he was dressed, they never cared about me being alone or us waiting for help. She's mad I know how they lied to me about the cna not allowed to help me. I have been left alone there w no cna & training a nurse I said was impaired on drugs. They got mad at me for saying that & tried to blame me for her incompetence. Do they have a case. I'm in college getting higher degree wats going to happen? I can get job for now but worried

When you say case... are you saying that they are taking you to court? I am sorry but we are not allowed to give legal advise. My suggestion is get in contact with a legal adviser on this matter. Good Luck

I don't understand.. You caused neglect? A CNA neglected a pt? A pt fell 300 times? What?

This pt had hx of over 300 falls. Administrator said only allowed to transfer with 2 asst dt he also fell with PT. I was the only nurse there for bldg. CNA that was there was not allowed to take care of him. No supervisors told me. They left us alone leaving me to try to transfer him alone which we almost fell. Called don...basically said ure s.o.l. wait till 3 rd shift gets there. I sat w pt until they arrived. They said I treated him like a child & he wasn't dressed properly causing dignity issues. They never addressed the fact I was trying to protect my license & his safety. No I'm not in court. Admin said she is reporting me to state.

Your post is difficult to decipher but it would appear that you require legal advice. The only legal advice we can give here is to inform you that it is apparent you need legal advice. Yep I am in agreement with Caliotter and will stand by my first statement that you need to find someone for legal counceling. There are so many questions I have, and this story has more holes and missing info then swiss cheese, but I am going to refrain from even trying to figure it out being I don't think we can help you anyway, and by giving more info might put you even more in a pickle as Caliotter has stated

I'm not sure I understand. Could you refrain from the text speak and abbreviations? I hope this isn't how you chart. I'm not trying to be mean, but if we're having trouble understanding, it's likely your coworkers are too, and clear, concise communication is essential in this line of work.

There has to be more to this story. From what I understand, this patient was in his boxers in his bathroom/bedroom and now you're being reported for issues with preserving dignity? That doesn't sound right. Why has he fallen so many times and why are the falls relevant to the incident here? Why is this in the CNA forum?

Anyways, I agree with the others. We can't give legal advice and 300+ falls is an identifying marker for that patient, so someone could read this and make a connection as to that resident's name and your identity. If you clean up your post and eliminate the identifying markers and rephrase so you're not asking for legal advice, perhaps we could discuss the situation a bit further and offer guidance within the parameters set by the forum rules.

I agree with everything you've stated. Particularly that people on All Nurses need to be careful. Especially with the tags added! For example, in this post we know the OP is from Indiana, and under suspension, etc. That combined with all the other identifying details in the post can lead to someone figuring out who this "anonymous" nurse is.

You need to seek a lawyer who works with nurses accused of neglect or abuse. Don't tell anyone you are considering

contacting a lawyer while you find one. Remove any information that will identify you in your post because there

are some details in here that can easily expose you to whoever lurks here who happen to recognize your case.

It is my understanding that this whole situation will be looked into by the state. You will surely be interviewed.

Be honest and tell them exactly what happened in the situation.

The state will not be interested in what happened in the past with coworkers, only in what happened in this situation.

I do know that if the resident is listed as a 2 assist and you go ahead and transfer with one assist (regardless of your reasons) and the resident falls(and even if they don't fall), you are at fault. It would be better for you to have the resident wait for toileting until you have the help that is required.

You are responsible for knowing your resident's needs and making sure they have them. The fact that you were not informed will not fly with the state.
