EMPLOYMENT-BASED VISA AVAILABILITY DURING THE COMING MONTHS

from the DOS website: The current level of demand in many of the Employment-based categories has been MUCH LOWER than anticipated. As a result, the June cut-off dates have been advanced significantly in an effort to maximize number use under the annual numerical limits. At this time it appears likely that there will be additional advances during the coming months.

this is great news for all of us waiting for visa numbers and for all of us who thinks that the CIR bill is the only way to get in immigrant visa.....let me remind you that the dates moving forward is NOT always the case. Visa numbers can retrogress and go back a few years as what happened before but this gives us a glimmer of hope

how to use the Visa Bulletin chart. example: if a Philippine-born nurse files his/her I-140 BEFORE JUNE 01, 2005 it means that an immigrant visa number is available for you and your family and processing will continue. This is applicable for both Consular Processing and Adjustment of Status.......

Fruity i to received the same letter from the NVC. As this concerns the June visa bulletin the NVC will take some time to sort through the applications and the automated msg at the NVC will also not change.

My PD date is May 12th 2005. I was up to DS-230 have all police clearences in my posesion. Not been requested as yet.

to my understanding, it is very important that your case is already completed in the nvc to have a better chance of a visa allocated to you.... mypd is dec 2005....if the visa bulletin advances to my pd (i'm hoping) and i'm stuck in packet 3...what happens.... after the retrogression, i inquired nvc about my case and this was their reply:

this petition is not yet eligible for further processing. the petition will be retained at the nvc until a visa number is available. the petitioner, beneficiary, or attorney of record will be notified when further consideration can be given to processing this petition.

the petition's priority date determines when a visa number is available for the beneficiary. the priority date is the date when the petition was filed at a department of homeland security (dhs) office or submitted to an embassy or consulate abroad. in employment immigration the priority date may be the date the labor certification application was received by the department of labor (dol). you may call (202) 663-1541 or visit our website at http://travel.state.gov/visa/frvi_bulletin.html for priority dates being processed.

the beneficiary should not make any firm plans, such as disposing of property, giving up jobs, or making travel arrangements at this time.

does this mean my case is already completed or still in process? do i get a better chance id my pd will become current?

You need to get approval for the DS-230 before anything will go forward. There is still no news out from Immigration on anything else advancing.

Thanks for replying suzanne4... I just want to ask who will recieve the letter?..is it the lawyer or me? when does packet3 stop processing....did they stop processing my papers when the retrogression took effect?...I thought even with retrogression they'd still go with the papers until it is completed and stop there until a visa number is available for you....

I am just curious I heard about this visa's retrogression issue from my friends what is this all about when was this effective and how long it has been this way and when do you think they will allow or stop this retro thing? What causes this to happen and how will they resume it again what will make them resume the process again? Thank you to all and good luck

basically the demand outways the supply. Too many people applying for a set amount of visas. It happened last year and just affected people from Phillipines, India and China. This year it is affecting all foreign nurses regardless of where they are from. Each country has a certain amount of visas allocated and once used you have to wait for the next batch to be released. Not sure how long it is going to last this time and we are waiting for progress through the US government
