I took A&P2 last semester and now a "friend" is taking it this semester. I still had all my tests and hw that counted towards your grade. She works full-time and she also has a child and I could see her struggling. It's hard for her to study when she barely had time to study! She asked me if I could "lend" her one of my exams from last semester and I was really happy to give it to her. It gave her an idea of how the exam will be set up and I didn't want her to stress over the first exam. :) .. Because the teacher didn't really change the questions around, she did really good. She thanked me and I was really happy to see her overjoyed. Well.. She asked me for the 2nd exam .. Ok first of all....... I worked my butt studying for every single exam ... I feel like she's not even going to try anymore because all she is doing is studying the question/answer. I already helped her out with the first one so she wouldn't stress over an exam but now.. she's just asking for more! I don't want to give her my second exam. Don't get me wrong, I want her to do good but I want her to do it on her own! I don't want her to "suffer" all the hardwork and stress that comes along with it but doesn't everyone? In a way, she is cheating but that's my fault..... SO I'm cheating too!!

PS.. She doesn't even ask for HELP.. I would be glad to help her. She just wants my exams and hw
Once a test is returned to you it becomes your property. You cannot be punished for giving it to someone else.
This is just plain incorrect. You can absolutely 100% be kicked out of school for doing this without the instructor's permission. Your argument that he gave it out and didn't pick it back up, therefore it is yours, will hold no water at all in front of the board, a court or anything else. You might want to review cheating and collusion definitions and policies.
By that same analogy your instructor gives back term papers. So does that mean you can give it to a friend taking a program in the next county over? She gave it back so it is yours right?
Who is most wrong in this whole situation is the instructor. He/she has set this up to happen. Your friend is learning the phrasing of the question and the answer, but not necessarily why the answer is correct. In most situations I would not give out the test, but let's say I had a younger sister just behind me in the program, who I felt would be a great nurse someday, but not the sharpest academically. Would I give her the test???? Probably. I am no saint. This is why I feel the instructor is the most at wrong. It gives unfair advantages to some students but not all.
Now I would see nothing wrong when tutoring your friend to say. "Remember this you will probably see it on the test" because that would just be giving advice as to what to focus on and she will learn the material needed.
If you truly don't know the moral answer to this, then go to the instructor. Tell him/her what you did and that the student is asking for more of the exams. And see if the instructor minds. If not, you are in the clear. If so, you aren't. And if you feel uncomfortable with asking the instructor or are unwilling to, you just answered your own question. If you thought it was okay on any level, you would not mind the instructor knowing.
This is the perfect test for you.

I don't consider this cheating at all. I was blessed to have a former student pass on his things to me and many other people in my classes have inherited material also. My opinion is if the teacher doesn't care enough to change the tests they don't care if you have old tests to look at. My ochem teacher hand writes every test that day so there is no way an old test is going to give you the answers. I have another teacher that gives out almost the exact same test everytime. Do I still have to study either way? Yes, I do because I do want to know the material. Knowing what is going to be on the test is just an extra perk. I have given past work of mine to people also to return the favor that was given to me. Once a test is returned to you it becomes your property. You cannot be punished for giving it to someone else.
