you can consider this thread as closed since information posted here became obsolete on may 11 2005, once president george w bush signed the apropriations bill in to a law to make additional 50,000 visas available for nurses. this thread was started on dec 11 2004 when the worst news hit rn community that the pd dates have been retrogressed to jan 2002 and nurses will be the hardest hit.

now its official.

pd dates for eb3 cases from india,china, philippines retrogress to jan 2002.

this is worst news for the rn community who wish to migrate to us.

this means that, rns who are already in us will not be able to file i485 (aos) after dec 31 2004 till the priority dates become current. its not clear how long it will take.

those who have managed to file aos will have a huuuuuuuuuge waiting time for their gc apporval.

those who are outside us, will have a loooooooong wait

for someone who is in us and has either cgfns/ncelx (with or without visascreen), the only option is to get an employer to file for i140 and 485 before dec 31 2004. this will make them eligible for ead and legal status in us.

considering the rn shortage, there are chances that they may introduce a new visa category or an exception for nurses. depends on how hard the empoyers lobby the congress.

There was another article I have read saying that Once NVC get new visas allocated for the 2005 year. It can reduce the backlog to a great extend itseems. And this system for on a fiscal basis. Anybody know anything regarding this???

I spend hours reviewing information from all over and all of the offices on a weekly basis. What I post is not something that I have made up in my head..

You still must take into account that these visas are also allocated to professionals, including IT people and there is a big backlash going on in the US right now becasue of the IT jobs that have left the US and gone to these other countries. So in some respects it is quite hard to get sympathy from everyone. Believe me, I am on your side, as you can see from all of my postings, I am just trying to set the record straight for most of you. For those of you that haven't received your Visa Screen Certificate to work on getting it and do not put your plans on hold. You will get your green card, it may just take a little longer, and anything really worth it, means it takes some time. Even look at most of the postings from nurses from the UK.....they are not under any type of delay and it is taking them on average two years to get everything done. So this is not really anything new.......

hello Im orlando from the philippines. I already have my cgfns certificate but still havent filed for visacreen certificate because im still waiting for the result of the TSE. I already sign a contract in one of the hospital in chicago. Do you think it would be process as early as possible eventhough there are regression. Im planning to take my master's here but my mom and her collegues discouraged me because there is a possibility to expedite the processing. is it true? I am really confused because i want to start my masters already. How long would the retrogression take effect to us Asian? Are my earned units in my masters here in the Philippines will not be credited when i planned to continue it in the US? For example, I already finish my masters would I be eligible to pursue different graduate degrees in the US like PhD, nurse practioner or nurse anesthetist.

Now to answer your questions..........I would go ahead and apply for Visa Screen Certificate as soon as possible. It will take four months for you to recieve the Certificate after you take and pass the TSE exam.

At the moment, even with your job offer, you are under the new rulings, and nothing will be expedited in your favor, at least at this time. I would go ahead and compete the VSC application so when things change you will be ready. In the meantime, have you actually applied to Illinois Board of Nursing for licensure? You need to complete this as well, as you cannot practice without a US license.

If you complete your Master's degree in the Philippines, it will allow you to go on for a PhD. If you try to transfer in the middle of your program, you will have problems getting all of your credits to transfer.

Be aware that it is quite difficult at present for foreign nursing graduates to get into an anesthesia program. You will need minimum of one year experience in an ICU before I would even recommend applying. The waiting lists are getting longer and longer.

One suggestion that I can make to you, if you are definite about grad school is to come to the US as a student...............but you will not be permitted to work until your visa number comes up..............that is something else to consider.

what will happened if after i filed for visascreen and then i receive a failing grade in tse? is my application still valid.

how long do you think will the retrogression will agonize us? what is the usual time frame in visa processing after you already sign a contract with your employer without retrogression? if with retrogression? do you think i can finish my masters during those period? the processing of my papers will be 1-2years. is it realistic? Thus the processing of papers are different from one country to another depending to your lawyer and employer.

if i finished my masters here would i be eligible to enroll for nurse practitioner program in the US? Being enrolled in that programs needs a master's degree or not?

i will take my nclex when im already in chicago(mercy hospital and medical center) -that was stated in the contract.

is the processing of student visa is faster compare to immigrant visa?

I do not like contracts that have you take your NCLEX when you are in the US. What happens if you do not pass the first time, do they send you back to your country? Many facilities have cancelled contracts with nurses that are involved with the retrogression. I only recommend that the nurse complete the NCLEX exam before they come to the US for this reason. I would go ahead and start the Visa Screen process. The application is good for two years, so you have time to get your exam done.

MY schooling was done in the US. I am an American RN who teaches in Thailand, but is currently back in the US.

If you are going for a nurse practitioner certification, you are better off and much further ahead just to do the enitre program in the US. When you finish, you receive a Master's degree. A student visa is much faster, but be aware that you have to be able to show funds available to cover your tuition and living expenses to be able to even get the F-1 status.

Did you actually sign with the hospital, or with an agency that represents the hospital?
