Well I just got kicked out of my CNA class....

so I guess it is pointless for me to continue with my RN after 3+ years of school.

I was just told that because of my background check, I could not attend any of my CNA clinicals since none of the clinics that my schools uses would accept me so this whole semester and $$$ has been wasted!!! I was also told that it would be pointless to continue with my RN degree due to the clinic thing. This is ********!!!

The only conviction I have on my record (and I am 38) is a misdemeanor for trespassing back from 94. I do have some crap on there from 1991 for burglary of a car, use of stolen CC, but all the charges were dropped, none of it ever made it to court. I also have a B.S. stalking charge from 1997 when I Ex had me arrested; she lied about the whole thing and so the court dropped the charges. I also have 13 counts of GTA from 1996, but all those charges are withheld adjudication so that means I am NOT a felon. Soooo though it looks like ****, the ONLY charge I have on my record is the stupid misdemeanor. This is ********!!!

I know that Florida just passed some new laws which pertain to criminal conduct, but none of those statues pertain to any of my past transgressions. They are directed more to medical misconduct and fraud, but like I said, I an not a felon in any regards.

I feel so lost right now that it feels like my head is filled with air. I had everything in my sights, I had my routine mapped out... Monday school, Tuesday off, Wed and Thur school, after my pre-reqs nursing, and so on... Now I just feel lost... BLAH!

Well I just got off the phone with the BON for Florida and they told me that even though the ******** stalking charge that my EX had me arrested on was DROPPED, that that is more than likely the reason I was kicked from my CNA class. ***!!! So Florida can now **** all over someones hard work and goals with some dumb $$$ law like this!!!??? I WAS NEVER CONVICTED FLORIDA, THE JUDGE, A FEMALE JUDGE AT THAT, DROPPED THE CHARGES!!!

Is being a CNA a requirement for the Nursing Course? If it's not and the Florida statues concerning the new time limit bars don't apply to you, would you be willing to try? It seems as though the last of the charges was over ten years ago and time passed is a factor that's looked at when deciding on licensure. What did the BON say about persuing your RN?

OMG! That is horrid!

None of this makes sense because I have 2 misdemeanors and I have no problem with hospitals being OK with my history.

Something else is strange....when I got my divorce eons ago (17 yrs), my ex had me charged with Harrassment and his girlfriend and his sister had me charged with "illegal use of the telephone". I was found not guilty of Harrassment and not guilty of one of the phone charges so the prosecutor dropped the other. NONE of this is on my background check.

I hadn't even been thinking about it when I did the background check.....because the FL BON requires you to report CONVICTIONS. It doesn't say CHARGES.

I would think about contacting the ACLU. You are being held responsible for a crime you weren't convicted of. That is against our constitution! Maybe they could take up your case!

No the CNA is not required for the RN course, but I do believe that I would receive additional points for obtaining the Cert when it came time to apply for the nursing program. I was doing the CNA so that I could get my feet wet per-say; I don't have any background in the medical field and I thought it would have served me well to be a CNA while I was doing my pre-reqs and nursing.

Well I talked to the Florida BON as well as the AHCA and between the two of them, I was thoroughly confused, lol. In the end however, I was told that it is my GTAs that are causing me this issue. It seems that though my adjudication for these felonies have been withheld, in the eyes of the medical field, that does not matter. On a good note, per the AHCA representative that I spoke with, since my charges have been withheld and stem from 96, I should have no problem getting a exemption for said charges. I am still going to seek the council of an attorney to discuss expungement.

So there may be some light at the end of the 10 year+ tunnel. I am glad to see that the past three and a half years may not have been a waste :rolleyes:

Thank you for your concern. As stated above, there seems to be a glimmer of light down this long darkened path. I just hope it is as simple as it sounds, lol. I will check into the ACLU tomorrow and see what they have to say about my situation; thank you for that little lead ;)

I can certainly understand wanting to get your feet wet, it's why I chose to become a Tech, for the Patient Care experience. I'm delighted that the time factor is working for you. :yeah: On a side note, in the event that the CNA is still not an option, maybe you can try for a Unit Clerk position in a hospital. No patient care experience but a foot in the door of a facility and medical experience through charting, supplies and working with Dr's when entering orders into the computer. Just a thought. If there is such a position in your state. :)

I am glad to see that you said you are seeking the advice of an attorney to see about expungement. At this point, do not give up on nursing. It may only be a matter of going through the steps of getting your record cleaned up a little more. Going through the hassle of doing that will help you all the way around. Continue with your prerequisites and your plans. Good luck.

Well I am going to see if I can take care of it myself first. I talked the the FDLE and they said that I should not need an attorney for something like this since my charges are over 10 years old and withheld adjudication. The FDLE officer said it would cost $75, but then there is the cost of the cert copies of the disposition from the clerk of the court; none the less, it is still way cheaper than $600 for an attorney.

My ex is going through a similar situation in Missouri. He completed his LPN program and applied to take the boards and was denied by the state. He has a misdemeanor marijuana charge and two driving under the influence charges on his record. He has hired an attorney and will be appealing the states decision. His is still in out patient rehab and is no longer using drugs. He is also having people write notorized statements on his behalf.

What I have told him is that they can't legally hold anything against you for the rest of your life. You have paid your "debt" to society and have moved on with your life.

What you should do is hold your head high and fight for the right to be a nurse. Your hard work and dedication should make it happen. I am in nursing school and am having problems with paying for it, but refuse to let money get in the way of my dream. I truly wish you the best of luck and hope that an attorney will be able to help.
