I am sure that many of you do not want to hear this. But it is the actual truth. There still is no special schedule for nurses, and the Schedule A is not included in the Visa Bulletin.
That the dates are current for the month of July does not state that it is over. There is a huge number of applicants waiting for the green card, in addition to nurses, and they have been waiting as well. Remember that most that came to the US under the H1-B visa, are also included with the EB-3 caseload. And many of their attorneys are much faster at getting things done. Example: When the window opened for petitions to be submitted in April for the October 2007 H1-B visas, there were more than a 150,000 submitted in less than one day. And they were gone.
Not trying to burst any bubble, but trying to be honest on this. There are only so many visas available per year, never unlimited number. And this Bulletin does not go into effect until July 1, 2007. And those dates are only for that month and if you notice there is also mention that if the visas get used up that are there, then the dates will not remain in effect all month.
For those of you that got stopped in the processing just before your interview, this will be very beneficial for you. If your DS-230 has been approved and accepted, then this can be beneficial to you. For those that are just starting the process, remember you at the mercy of your agency and attorney and how fast that they will do things. We have seen multiple posts over the years of mistakes made with petitions that delayed things for quite a period of time. There is also a considerable raise in immigration fees going into affect at the end of July that will delay things for some people as the agencies are going to be holding back on paying of fees.
Those that have been paying their own way will find that they may get thru faster.
So please, do not make final plans to leave for the US until you actually have an interview date given to you. We saw what happened last fall to quite a few of you here.
Until there is another Schedule in place for nurses, the retrogression will not be over. Just an open window in the scheme of things, but definitely not over. Look at what happened even last month when the dates were moved up for the PD, you did not see a significant movement of anything. When money is needed to be paid by the agencies, everything drops to a crawl.
could you pls tell me about the DS230 is updated or the last version is existing. the last version expiry date was July-31-2007. I could not find any latest in any of the sites.
The DS-230 with the required bar code is sent out by NVC when they want it. You will not find it on any of the sites that are posted. They will not accept any from you if they have not requested it.
We are seeing some attorneys send out one to be completed, but if it does not have the bar code, it means that they just want to have the info available so that they can transfer the information and then send it in when it is requested.
Hi Suzanne! I had my interview last 23rd of July but unfortunately, I didn't realize that I need police clearance from my country of birth. They told me to send the lacking document back to them together with my passport and they will give me visa after a week. I sent my documents 2 weeks after but they were returned to me and US embassy said there are no more available visas:o as they were only limited and that they will just inform me when there are new visas available. My question is, do you think I will be given a visa when the October or new fiscal year visas become available? Thank you so much by the way for this brilliant website.
We do not know what they are going to do with the visas as of yet for October. Sure, it is a new fiscal year, but USCIS was forced to accept petitions up to today for the I-485 when there were no visas available. So not sure how they are going to handle that.
And which is your country of birth? That is more important than anything else at this time.

Hi! Thanks for replying. My country of birth is Philippines. Anyway, I guess I just have to wait and see. I just don't understand how they work in giving out visas 'coz I initially thought that once you're interviewed, a visa is already reserved for you. And the fact that they told me that they will give me my visa a week after they received the lacking document. They could have told me right there and then that I will have to wait now 'til the next visa numbers are available. It would have save me all the trouble and money of making sure I get my police clearance ASAP. How long by the way is the medical valid for? some says it's six months some says it's one year.
Things are changing on a daily basis. You went to the US Embassy in the UK, correct? They are used to dealing primarily with nurses from the UK. And they have not been under the retrogression in the past.
When you did have you interview, there was a visa for you. But because it was not completed that day, the number went to someone else. This was never an open period in immigration for everyone to get visas, they were just trying to clear up pending petitions that had been sitting there, they just used up visas that were never used, as we say they were just recapped visas.
Not sure why your attorney did not tell you specifically that you would need that. This same thing has been discussed so many times before. If you had forgotten the document at home and were able to send it to them the next day, that is one thing, but the fact that you did not have it is what caused you to have to wait.
With the retrogression still in effect, we still do not now how the visas will be assigned when some are released in October, but also remember that USCIS got forced to accept the I-485 up until today when there were no visas available, so anything can happen. But I would not think that you will be able to get one in October, hope that I can be surprised, but doubt it.
They have nothing to do with the visa number that is assigned to you, it was assigned before you had your interview. Same exact thing that I told to any that had their interviews set, do not change the date, the visa will be gone. And sure enough, for the ones that delayed, there were no visas available. When your file was complete and there was a visa available for you that day, then your file was sent to the US Embassy. This is not normal times, everyone is still under the retrogression. You had the one date, but did not have all needed material with you. Talk to your agency and the attorney for not telling you exactly what you would need.

Does it also mean that my only chance now of getting a visa is to wait for another batch of recaptured visas to become available again? Please take the time to do some reading on the forums. For those that have been in the US on another visa, they could go thru the AOS procedure, and long story made short: USCIS was forced to accept petitions when they did not have any visas available, so those visas are going to come from somewhere. And the recapped visas were used up, that is why there were only a certain number there to use. Retrogression is based on where you were born, not where you are currently living or have citizenship from. Not sure when you will be able to get a visa at this point, there was a visa number for you, but you did not have everything completed when you had your interview.
We do not know what will happen next month, but I am still suspecting that those from the PIC countries will still be under the retrogression, so that will include you. You will need to wait until the October Visa Bulletin is released to have any idea of what will happen next.

I am from Israel too. At this point it doesn't matter so much what country you are from because there are no visas (green cards)available.
Did you begin with your immigration process? Some of the stages you can pass regardless of retrogression.
