Retrogression Is Not Over

I am sure that many of you do not want to hear this. But it is the actual truth. There still is no special schedule for nurses, and the Schedule A is not included in the Visa Bulletin.

That the dates are current for the month of July does not state that it is over. There is a huge number of applicants waiting for the green card, in addition to nurses, and they have been waiting as well. Remember that most that came to the US under the H1-B visa, are also included with the EB-3 caseload. And many of their attorneys are much faster at getting things done. Example: When the window opened for petitions to be submitted in April for the October 2007 H1-B visas, there were more than a 150,000 submitted in less than one day. And they were gone.

Not trying to burst any bubble, but trying to be honest on this. There are only so many visas available per year, never unlimited number. And this Bulletin does not go into effect until July 1, 2007. And those dates are only for that month and if you notice there is also mention that if the visas get used up that are there, then the dates will not remain in effect all month.

For those of you that got stopped in the processing just before your interview, this will be very beneficial for you. If your DS-230 has been approved and accepted, then this can be beneficial to you. For those that are just starting the process, remember you at the mercy of your agency and attorney and how fast that they will do things. We have seen multiple posts over the years of mistakes made with petitions that delayed things for quite a period of time. There is also a considerable raise in immigration fees going into affect at the end of July that will delay things for some people as the agencies are going to be holding back on paying of fees.

Those that have been paying their own way will find that they may get thru faster.

So please, do not make final plans to leave for the US until you actually have an interview date given to you. We saw what happened last fall to quite a few of you here.

Until there is another Schedule in place for nurses, the retrogression will not be over. Just an open window in the scheme of things, but definitely not over. Look at what happened even last month when the dates were moved up for the PD, you did not see a significant movement of anything. When money is needed to be paid by the agencies, everything drops to a crawl.

Our priority date is March 2007. Our DS230 was filed Oct 2006 but we filed again last July 1 in the light of this so called hiccups. Until now we dont know where this will take us. Judging from the roller coaster ride we are in, I suggest you dont expect much than what it really is-- a bumpy ride.

If you ask me, I'd say the best chance would be the "bridge" legislation they are trying to pass. I just don't know why its taking so long. Why some senators are voting against it when its clear that they are in dire need of nurses?

If you have been asked to submit DS230 or renew the forms already recieved then you are a lot closer to getting a visa but unfortunately it si a case of waiting and see what comes up. Atleast you are a lot closer than some of the others.

oh ya...My PD is Mar 06....and my ds230 is October 06 too. Sooory!:lol2: But i dont think it went through. Thats why my lawyers took chance in passing it again this July1 when it supposedly opened for a while. I doubt it was processed again this time. Does that mean when retrogression ends (for real) I need to pass another ds230? Or the one I passed last July 1 sufficient?

If a I140 is filed now for a nurse, even though there is no Schedule A visa category, will a nurse be given a schedule A visa if they become available in the future?

if you have submitted a new DS230 then you should be OK, the old ones expire at the end of this month. NVC are only asking for ds230 on the ones they want to review so good that they have asked for it, a lot are not beeing asked just yet

Hi jakey! I am wondering just the same. I am hoping that dates would be a little beneficial for us. Of course there are a lot in line for EB3. But I think when Oct VB comes out, the PD's cases completed will play a big role. The older the PD and case completed the better the chances....

That is where you are mistaken, there is not a dire need to import foreign nurses. It does not solve any problems. They need to fix what is wrong here with the not enough slots for students that are American. There are agencies that are marketing up and down that there is a severe shortage, there is not in many areas.

And the "bridge" legislation as you call it has already been voted down.

Even if a foreign nurse gets hired tomorrow, average wait time until they are in the US is about 18 months now, and then they require orientation for several months, so what has been fixed? You can put an American thru school and provide a job for them when they finish in about two years, makes alot more sense to do that.

Your country now has 632,000 students in nursing school. Where do they think that they will be working? There are already more applicants than there are visas. That is why the retrogression was caused in the first place.

We do not know for sure now since the USCIS was forced to accept the I-485 visas at this time when there are already no visas left.

Expect a retrogression to continue in October, at least for some countries. There are many more applicants than there are visas; many, many more.

And without visas being assigned to the Schedule A, which is non-existant right now, will not be that beneficial to nurses. Many more from other professions that are ahead of you.

do you have any idea, when the visa number will be available? can we hope it will open again in oct?

my iv interview cancelled due to non availability of visa number in august.
