If a I140 is filed now for a nurse, even though there is no Schedule A visa category, will a nurse be given a schedule A visa if they become available in the future?

Thanks! That is perfectly clear now. I guess that is why recruiters and hospitals are not interested, as all you can do now is the I140, and nothing else.

The reason I asked, is because I had read this link: http://www.hammondlawfirm.com/alerts/11.02.2006_hcalert.htm and to quote a paragraph: "How Does Retrogression Impact Schedule A I-140's; Can I still File an I-140? Yes. Retrogression does not impact the employer's ability to file Schedule A petitions with the USCIS. Employers can continue to file Immigrant Petitions for Alien Workers (Form I-140) with the USCIS, and those petitions can still be approved. The USCIS will also continue to forward approved petitions to the National Visa Center ("NVC"). Similarly, the National Visa Center will continue to process approved Schedule A I-140 petitions by issuing Fee Bills and collecting "Packet III" documents. However, U.S. Consulates will not assign interview dates and will not be able to issue immigrant visas to Nurses and Physical Therapists until retrogression for Schedule A category ("EX") is resolved."

Once the I140 is approved and forwarded to NVC, will they process the case? Will they issue DS-3032 and Fee Receipt, and send and receive back packet 3? Thanks

Suzanne's study guide really works. I passed!
In the first 3 months, I read each chapter, highlighted points, and at the end of each chapter, I answered all the questions on the CD for that chapter in study mode. In study mode, I did not know what % I was scoring. In the last 2 months, I answered the questions on the CD in Exam mode. There are about 22 sections on the CD, and you get 100 questions for each section. There were about 10 sections where I scored 58-68%, and I managed to repeat these in Exam mode, just before I sat for the exam. On the 2nd attempt I was scoring around 80%.

Suzanne's study guide really works. My exam cut off at 75 questions. The only book I used was Saunders Comprehensive Review. I spent about 3 months reading the book, and 2 months on the questions. I also had Lippincotts, Mosbys and Nclex-3500, but did not get a chance to start on them as I ran out of time. I therefore thought I would fail, but Suzanne was right, you can pass with only the Saunders book and her study guide. Thanks Suzanne!

CES and make-up courses
Ethan, thanks for that info. I have already paid the fee to the Texas board and submitted my fingerprints. They say that once CGFNS approves CES, it should only take about 10 days for the ATT.

CES and make-up courses
Hi All I have just graduated as a RN in South Africa, having done the bridging course. I have already applied to the Texas nursing board to do the nclex exam. They require I do the CES thru CGFNS. I am currently doing make-up courses and clinical hours in psych and midwifery, on my days off, and should finish these in August. Should I apply now to CGFNS, and not mention the make-up courses? I was thinking that they could in the meantime verify my enrolled nurse course and license, RN course and license, and then request the make-hours from me. By that time, I should be finished with the make-up courses, and send it to them, and be approved a lot quicker. I know that a lot of RN's don't even know they require the make-up courses. Or should I wait until I have completed the make-up courses to apply for CES? With the first option, would I have to apply for CES a second time, once I have done the make-up courses, or is something they request as part of the first application? Many Thanks Meloniez

Hi I would like to work in Houston, Texas. Should I apply to the Texas BNE or are there advantages to applying to NYBON? For TXBNE, the CES can be done thru CGFNS, ERES or IERF. From reading these posts, it appears as though CGFNS is slow and it can be difficult getting hold of them. Has anyone done a CES thru ERES or IERF? ERES website says their evaluation can be done in 10-15 days, once all documents are received, and they also have a 2-day rush service for a fee. Please advise. Thanks Meloniez

Tourist visa and AOS
Hi Suzanne I am still 6mths away from graduating as an RN, but do have 10 years as a LPN/LVN. I have already attended an OGP seminar, but I'm concerned that they may not place me in Houston, where I would like to live. Are there hospitals in Houston that would employ and petition me? Not looking for any names at this stage, just want to find out if there are hospitals that would do it. Cheers, Meloniez

Tourist visa and AOS
I have seen posts stating that there are hospitals that actually prefer to do AOS for nurses on tourist visa, as they can be working in 90 days. I have also seen posts stating that you need to convince USCIS that you had no immigrant intent, and therefore risk getting AOS. Does anyone know of actual RNs who have successfully done this? Is there anything specific to do to make sure there are no risks? How long should one wait after entering US, to file AOS, to avoid suspicion? Would it be possible to come over with my husband and kids for a 4 week vacation, then find a hospital willing to petition, and then do the AOS? I would make sure I have visascreen before entering US.

If you apply for Visa Screen, and CGFNS verifies all your credentials and you have passed the English exam, and you then write and pass Nclex exam. Will you still wait 4 months for Visa Screen Certificate, after Nclex results are submitted?
