I am sure that many of you do not want to hear this. But it is the actual truth. There still is no special schedule for nurses, and the Schedule A is not included in the Visa Bulletin.
That the dates are current for the month of July does not state that it is over. There is a huge number of applicants waiting for the green card, in addition to nurses, and they have been waiting as well. Remember that most that came to the US under the H1-B visa, are also included with the EB-3 caseload. And many of their attorneys are much faster at getting things done. Example: When the window opened for petitions to be submitted in April for the October 2007 H1-B visas, there were more than a 150,000 submitted in less than one day. And they were gone.
Not trying to burst any bubble, but trying to be honest on this. There are only so many visas available per year, never unlimited number. And this Bulletin does not go into effect until July 1, 2007. And those dates are only for that month and if you notice there is also mention that if the visas get used up that are there, then the dates will not remain in effect all month.
For those of you that got stopped in the processing just before your interview, this will be very beneficial for you. If your DS-230 has been approved and accepted, then this can be beneficial to you. For those that are just starting the process, remember you at the mercy of your agency and attorney and how fast that they will do things. We have seen multiple posts over the years of mistakes made with petitions that delayed things for quite a period of time. There is also a considerable raise in immigration fees going into affect at the end of July that will delay things for some people as the agencies are going to be holding back on paying of fees.
Those that have been paying their own way will find that they may get thru faster.
So please, do not make final plans to leave for the US until you actually have an interview date given to you. We saw what happened last fall to quite a few of you here.
Until there is another Schedule in place for nurses, the retrogression will not be over. Just an open window in the scheme of things, but definitely not over. Look at what happened even last month when the dates were moved up for the PD, you did not see a significant movement of anything. When money is needed to be paid by the agencies, everything drops to a crawl.

the new year allocation starts in october hopefully because your interview was cancelled you will get one but really no one can predict. keeping fingers crossed for you
thank you for the reply Suzanne.....does this mean then , that visas released on October will be prioritized to those who used the AOS route? If only they could come out with a specific PD, then at least we would know where we stand.

there will be new visa numbers issued in october. however, we do not know how they will be used. especially since uscis was forced to accept petitions for the i-485 when they do not have any available visas. we do not know if there will be a separate schedule again for nurses, or if any countries will still be under retrogression. i am expecting that the pic countries will be under it, as well as mexico; just as we were expecting last year. there are still more applicants from those areas than there are visas that are assigned to those from those countries.
once we get some idea of what is happening with the september bulletin, we have some better idea. but even with the retrogression continuing, if you did have an interview that was cancelled for august, you have a higher chance of being able to get one in october. but that is not guaranteed by any means, just a better than 50% chance.

I am a peruvian nurse living in Spain, but willing to jump to the States, so I was reading and following this forum amazing advices. But unfortunately Im dissapointed about this post I have just read :
Even if a foreign nurse gets hired tomorrow, average wait time until they are in the US is about 18 months
Is that true Mrs Suzanne? it makes me so unhappy because I am about to take NCLEX in Germany (registered in Florida BON) so how much time should I be prepared to be waiting?

It is not a quick process to move to the US. Currently retrogression makes it longer. Once you have passed NCLEX you have to find an employer, they have a process to follow before they can file I140. All I140 for nurses are filed at Nebraska and then they decide which files are to be transferred to Texas, both service centres are taking approx 6 + month to get approval more are over 9 months. Once approval your file is transferred to the NVC and then it is a case of wait for visa. The average time is 18 months but can expect it to take longer with retrogression

AOS is a way of changing visa and a lot do it in the US by converting their current visa to a GC ie H1B or F1. If coming into the US on a tourist visa or visa waiver (if country in the scheme) it is actually illegal to do it and frowned upon by immigration. I would suggest you knock this route out of your mind. Plus with retrogression in progress there is no visas to convert so can't be done as you have to be in the US for atleast 90 days and then can take several months before you get pemission to work so look on 5 months with sufficant funds to support self. But like I said not an option at the moment. There are plenty of threads on this subject try doing a search with keywords and the forum seach facility

The US has been under a retrogression since October of last year, not sure why you ever expected to be able to just jump over to the US and be able to work. Just because you get a license, that does not give you permission to work in the US, you must go thru the immigration process. And right now, there is still a retrogression, and it is actually illega to come to the US on a tourist visa and then stay. Not a good idea at this time since there are no visas available, and it would be considered taking cuts in front of everyone else. There are those here even from the UK that have been waiting for more than two years for some reason or another.
You may wish to rethink when you will be in the US, there are more applicants than there are visas.

I get the retrogression idea, but There is one thing I didnt understand Silverdragon. The files are processed in Nebraska and then in Texas (or theyre in Nebraska or Texas). And the waiting time in the NVC for the visa is...how many months average?

i'm sorry to hear that interivew was cancelled. there will be visas on october, but it is not for everyone. no one really knows who'll be the lucky ones to have a visa on october until the dates are released. lets just hope for the best.
