Retrogression back on track .... a rumor???

Hello,

My attorney told me today that there is a persistent rumor that visa numbers will be unavailable (once again) in few days. He asked me to call him at the beginning of next week... he will certainly have more information then.

About 2 weeks ago, he gave me some good news: I could apply for a temporary work permit which will give me the chance to start working...while waiting for the green card. But now, I don't know what's going to happen if visa numbers are not available from July. If anyone has an attorney who mentioned that rumor, let me know. Obviously, if the moderators of this forum have additional info...

The AOS route are only for those who are in the US and can only be filed when visas are available or Current. The I-140 (petition) can be filed anytime. Retrogression or not.

Lawrence, you mean the employer can still file for I-140 anytime? it is only the AOS is affected with this? if the employer files AOS, you have to wait till Oct 2007? thanks!

There is no AOS petitions that can be submitted, and no idea of when they will be accepted again. There is still a retrogression in placen, and it has been in place since last October. Last day that AOS petitions were accepted was October 31 of 2006.

The I-140 can always be submitted, never has been under the retrogression to begin with. But that alone does not give you permission to work in the US or adjust your status.

The employers that were truly going to do something to start the process have. The rates go up significantly at the end of July.

Yes, the I-140 can be filed anytime. Retrogression or not, and w/ either route (AOS or CP).

This very recent event just states that USCIS will not accept filing of AOS this July for those who are in the U.S. already for the reason that they claim to have allocated the remaining visas that was recapped (crumbs or leftovers, if you may) in the month of June. It is being estimated that an unprecedented 60,000 visas were allocated just for the month of June, 2007. How it was exactly allocated we still don't know and we would have to wait for anymore revisions or updates to the Visa Bulletin for the new cut-off dates

for each country. The only thing for sure is that all visa numbers are claimed to have been exhausted already for fiscal year 2007 (ends Sept 30, 2007) and new ones will only be made available in Oct. 2007, w/c is the start of fiscal year 2008.

Yes, that is correct, they haven't. The issue was that the DOS released a Visa Bulletin 2 weeks ago that said that all EB categories will be Current starting July 2, 2007 w/c will pave away for filing of AOS applications and so everyone did jump on the opportunity and prepared for that and even sent AOS applications over the weekends so that it can reach USCIS service centers on July 2, then on that very same day, the DOS reversed their prior bulletin saying that it will not be Current after all so it will be rejecting all the AOS applications.

There has been no AOS petitions accepted for nurses since last October 31, 2006. They were expecting to be able to submit them yesterday, but that got put on hold. They were using recapped visas and have gone thru many of them already.

Next visas will be released in October with the new fiscal year........will have to wait and see what is in the Visa Bulletin for then which comes out mid-September.

I just have a question, I called the NVC on Monday and they told me that they sent a letter to my lawyer at the beginning of June 2007 with the DS 230 and asked for the fees. Can we still submit the DS 230 now or do we have to wait October when new visas will be made available ?

My PD is November 2005.

once fees are paid they will ask for DS230, do not send it until they ask for it otherwise they will send it back to your lawyer
