  1. I suppose that I was lucky on this one. I was advised on this website few months ago not to do the adjustment of status. Sorry but I did it and guess what I got the work permit at the end of august, and I started to work at the beginning of november in NYC I'm glad I did not listen the moderator who told me to stay with the CP route. Otherwise I would still be at home right now struggling to pay the rent and everything that goes with it. PD nov 7th 2005
  2. Hi My pd is nov 2005, current on friday. Need to know what kind of documents we need to send with the DS 230. And I read everywhere that we need a NBI. Is there anyone that could tell me what it is ? and where do we obtain it. thank you
  3. Thank you, of course I will check the visa bulletin. But I still don't understand how someone with a PD in april 2006 and an I 140 approved in dec 2006 could get a green card, not the AOS the GC ...especially india is one of the PIC countries no ? Thank you
  4. Hi, No he did not file AOS because I was away in France from the 17th of July until the 19th of September so I was not physically present in the US. We continue with the CP. My life is on hold since 2 years like many others....
  5. Sorry but there is something I don't understand. Your priority date was April 2006 mine is Nov 2005, Your I140 was approved in Dec 2006 mine in June 2006. And you have your GC which is great for you ? But is there something I missed about PD ??? So why I don't have mine, I'm also on a H4 visa. Thank you.
  6. Hi Suzanne, I have a question for you: How does the USCIS, or whatever the name of the institution in charge, estimate the cut-off dates? I really need to know. The way I see it, in the next bulletin the cut-off date will be 1981....no kidding. How accurate is the date? Does the agency look for the oldest case that 's gonna be the first to get a Visa number when they will be made available. Few months ago, I remember that the cut-off date was sometime in 2006. Now we are back 4 years earlier. My PD is November 2005. Current Cut-off date for EB3 is August 2002. Does it mean that I won't see any progress of my case for a loong long time...count few years. I filed the DS230 and it was submitted. Thanks for your reply. PS: just to mention that some individuals want to go to DC to protest against the current status of the immigration program. I just want to let you know that once you get a voter ID card...your voice will count....until then...I don't think there is anything else to do than wait for the people who decide of the cut-off date to pick up your year in the lottery basket.

I just have a question, I called the NVC on Monday and they told me that they sent a letter to my lawyer at the beginning of June 2007 with the DS 230 and asked for the fees. Can we still submit the DS 230 now or do we have to wait October when new visas will be made available ? My PD is November 2005. Thank you.
  8. I'm french stuck in the USA and retrogression...and There is no english clinic anywhere except in Paris where there is ONE. You absolutely need to speak French. If you don't have a EU license then you need to apply to a school of nursing in France and do the program to get the French state diploma. Good luck
  9. Dear Suzanne, Thank you for your reply. Regarding the I-140 approval, the only thing that I know is that it was approved in March 2006 ... after my attorney words. However, I don't have any written prove of when it was approved. I am tempted to believe it was approved because my attorney sent me a copy of a letter he received from NVC in November 2006: "This letter pertains to the immigrant visa petition filed on behalf of .....". On the letter, it also appears the priority date: 07 November 2005. It would be interesting to know how attorney's working for an agency are paid. I don't know if the Hospital pays him per cases or per hours spent on a single case. For the latter, it is beneficial for him to let things last a long time. Those are just speculations.

I have 8 years experience as a nurse in a Hospital in Paris. Prior to H4, I was on a J2 and work for 2 years for a NYC Hospital. After that, I had to go back to France for personal reasons. At the end of 2005, I contacted the same NYC Hospital, and they offered to sponsor me for the GC. Anyway, I never thought that the process would take that long: I have been putting my life on hold for almost 2 years and it seems that it's not going to end up soon. Still, I would like to get an answer for the following question (PLEASE): Is it possible to request my case number directly from USCIS Customer Service? Suzanne, in your latest post you talked about people who chose a career path for the GC sesame. However, what about people who like their job and would like to work in the US!

Hi, you are perfectly right, Suzanne: it's naive to believe that everyone is gonna be satisfied of the outcome at the end of July...it is certainly going to happen like for the H1B. >Any petition that is filed for immigrant status gets a number, no > matter if it is France, the UK, or any other country. Everything > goes thru the same procedure. Especially true if you started the > process thru Consular Processing. That's what I thought. If my attorney is unable to give me my case number, is there a way to get it via USCIS Customer service Center? If indeed, it is the case, should I have some documents in hands when I call them. One additional question: can I ask my attorney to provide me with a copy of all documents of my case starting with the I-140? Finally, what are the chances that employers sponsoring for the GC get tired of the loonnng process and decide not to pursue with the nurse GC application: i.e they don't pay anymore the fees etc... Basically, are we (nurses & employers) all in the same boat? If not, can the employers leave the ship prematurely?
  12. Thanks a lot Hathaway for the message: very informative. BTW, I went on AILA web site but it seems that one must be a member & an attorney to read the posts. Anyway, here is a useful link that mentions the latest AILA Update. It is clear that it will be hard to get the I-485 thru if they receive it after the 2nd of July. I got difficulties to understand my attorney strategy for my application. BTW, my attorney is paid by the Hospital that sponsors me for the green card (*). Mid-june, he told me that the best for me would be to put on hold the Consular process and apply for the temporary work permit that goes with filing for permanent residency. I met him on Wednesday this week to get a bit more infos on the documents required for the application. Now (on 29th of June), 3 days after our last meeting, he's talking about 'rumor' that visas 'of july' will run out quickly, and that my application I-485 will certainly not go thru. I am just confused by his behaviour. Indeed, for about 1 week or two, moderators of this web site (who are not attorney) are warning on the very small chance that applications I-485 have to succeed: too many application for limited number of Visas. My attorney waits the last week end of June to inform me of 'rumor'. Kind of pathetic if it was not so devastating for me. Also, can someone provides me some comments on this issue: I asked my attorney for my USCIS case number so I can check online the status of my application. According to him, because my application is filed in France, I am not allocated a USCIS case number. (So far, I only have a VNC case number.) It just seems weird that because an application is filed in a foreign country, no case number is allocated. Just for info, I started the Green Card application (I-140) while in France. From the beginning of the year, I have a H4 and live in the US. Thanks. (*) Someone in this forum mentioned that things can go faster if one pays directly the attorney.
  13. I am sponsored by a Hospital for the Green card. My PD is 7th of November 2005. My attorney (paid by the Hospital) called me last week to tell me that the priority date were current. I'm in the US since january 2007 under a H4 visa. The lawyer told me that I could get a temporary work permit. According to him, I can either file for the temporary work permit or wait for the consular processing. I don't understand why I should choose between two procedures that should be processed in parallel? The latest document from NVC that the lawyer forwarded to me was to inform of the backlog in Visa numbers (that was in nov.2006). Since then, I have not received any documents from USCIS nor NVC. Is this usual? If I get the work permit, will my husband be able to get one too? He's currently in the US on H1B. Finally, can anyone detail the step by step (or form by form) procedure from the begining of the application to actually "getting" the green card? to know where I stand on that ladder. Thank you
