What is Arraignment?

Once the accused is represented by counsel, the more formal part of the arraignment, the reading of the charges, takes place. The accused is expected to enter a plea: usually guilty, not guilty, or no contest. The no-contest plea means that the accused is not admitting guilt but will not contest the charges.

The article references a letter from the DOH/BON which clears up the rumor that they had investigated and done nothing.

It is really disappointing that it's true. Appalling.

Sad. But probably will not be hirable again

I'm just as surprised that the TN BON is not taking action as I am that the DA filed charges.

Do you think it is possible the DA filed charges because of the BoN's lack fo action?

She still is employed. Centennial only suspended her when the charges were filed. They really had no choice.

I think she’ll be gone after all of this, due to the negative publicity-my sister lives in the area and she says some of the rumors are pretty bad; I didn’t ask about the rumors, since they are just that, rumors. I don’t know who would hire her with that following her. I wouldn’t want her caring for me or my loved ones, I don’t care how sweet/caring/compassionate she is. She was negligent, and that will be a hard situation to get beyond. News/gossip hounds will keep the story alive.

I think that was actually confirmed in an article posted on one of these threads... That the charges came due to the fact that she was not facing any other discipline.

Well...it would be a little awkward to figure that in with all the rationales given here for why she is appropriately charged with reckless homicide...

I looked at the articles. It seems that her attorney implied this but it was not officially stated.

The article at the link from @Karen_tn_37211 (I believe that was the one) stated that the attorney provided a letter to the reporter (re: no further action) signed by Antoinette Welch on behalf of the DOH/BON following investigation. So I do think that part is true although it would be nice to see the referenced letter.

(I can't read the particular article any more to confirm because I've used up my free articles...). ?

Let me know if that's not the one and I'll try to remember where I came up with the idea that they've now reportedly produced some proof that the BON did investigate and decide upon no further action.

Yeah, it's a little confusing but I wonder if the BON is under the umbrella of the DOH. If it isn't I can't see why they would get involved at all (there already being a board in place to handle these matters).

Yes, I think so. When going to the BON site it appears to be under the umbrella of the DOH.

Some consistency would be nice. The DAs office has made a strong statement about why this prosecution is appropriate. How is it that that would come into play only after someone else takes a pass on what is arguably a far lesser form of discipline?

[Incidentally, but hopefully neither here nor there, there seems to be a bit of history/bad blood between Mr. Funk and Ms. Welch.]

Regardless of anything, I don't think there's any excuse for not addressing the licensing issue.
