Pt's FB pictures of me

Published

I am a nursing student, and my dad is an ON/GYN. I recently helped him deliver a baby, and his pt took pictures of us and posted them on Facebook. I would like to have these pictures, as I hope to become a CNM, and would love to have a picture of my dad and me at my first delivery. (There are pics of us with and without the baby.)

Is it a HIPAA violation if I click on the "..." and save these pictures to my phone since she made them public on Facebook (we are not FB friends. I searched for her.) I really want these pictures, but want to have them legitimately. Thanks!

If a name were protected information, why was I able to go to a hospital yesterday and ask for a person by name and be told what room that person was in?

Most facilities have opt out for patient directories. We opted out when my father was admitted because he was immediate family only and nosy neighbors & clients would blatant lie and claim to be family. If you called or went to the front desk and asked for my dad by name you would be told no one there by that name. My mom was the gate keeper of information.

If observing one's own photo placed without consent by someone else on a non-protected public website amounts to a violation of "someone else's" privacy and federal law, then our society, healthcare system and federal laws are screwed up beyond comprehension, and probably beyond repair.

How did you know the person's name?

What's the point of the question?

IN the facilities I have worked the patient signs permission with their admission paper work. As a patient I have signed the paperwork to allow my nae at the desk to visitors and so they can connect phone calls to my room if family calls and ask for my name and not know my room number phone..

Maybe so, but I've never seen it.

Different places do things differently.

Did you get the name from work and then show up at the hospital looking for them?

No.

......

A name wouldn't be protected information either way.

We are not going to agree on this...I cry Uncle and bow out gracefully. Where I work they would have a stroke if a nurse contacted a patient for a picture. But each person must make a decision and suffer the consequences if there are any to suffer.
