Ohio Requirements for Reporting a Pending Criminal Charge to your Employer

Nurses Criminal

Published

I have a problem. I have been an Ohio STNA for 3 years now, and currently work in a Skilled Nursing Facility.

On Saturday, I was notified by mail that I have a Pending Assault charge against me, and I am being summoned into court over it. I have an arraignment in 2 weeks, but it could be a while before I actually go to court and have a trial.

Let me just say, I swear, with God as my witness, I am innocent, but I suppose my fate is in the hand of the judge at this point. I've never been in this situation before. I've always done the right thing, flown straight, and upheld the law, so I don't know what to do in this situation.

My question is, in the State of Ohio, am I required to report the pending charge to my DON? The charge is a First Degree Misdemeanor, but I'm pretty sure it is still a Registry Offense (2903.13 Assault). I kind of don't want to report it to the DON, but at the same time I would rather she hear it from me rather than hear about it some other way. Also, I would hate to not report it and then get fired for what they percieve to be withholding information. What should I do?

please consult a lawyer for best advice...looks like a prnding charge is not reportable to board.
