I am starting a new thread to track cases from NVC - embassy to GC.
The best news for RN in China, Phillippines and India has been great and informative thread, but I think it is more appropriate and convenient if we start a new thread.
Also with the rapid scheduling of interviews for most of us, I am looking beyond the CP and anticipating the GC!
The August interview schedules are out already in India, and recently in the Philippines and hopefully in China.

Not to dampen anyone dreams... even if you are scheduled to have an consular interview, it's not a guarantee that you'll get a visa. Remember you have to show an active job offer during the interview before you get the visa. Also, you have to remember that issuing of visa depends on the availability of visas during the interview and not on the your PD and availability of visa today.I have a couple of filipino former co-workers who are working here in the US under working visa whose PD is 2004 but their lawyers said that it will take longer now to have have AOS (equivalent of consular interview) because there's no available visa.
also, I have a co worker who has a greencard (pd2003) but his wife, who is also a nurse, is working under working visa and is having difficulty getting a greencard because there's no available visa. To think that she is already here working.

AOS is different from consular processing. AOS was faster when schedule A was in effect in the 2005-2006 period. I have meany friends who took advantage of this and had their GCs in 4-6 months. Now that PDs are retrogressed, according to Atty Ron Gotcher, those who are documentarily qualified uder consular processing have a better chance of getting their GCs faster. Under AOS, even if your PD is current, its like a lottery. Because there are thousands who have the same PD as yours, you'll be lucky if they pull out your file. Well, all this info I got from Atty. When I mentioned about my former co-workers who are working under working visa and waiting for AOS, I did not intend to imply that AOS is faster than Consular processing. When I mentioned about my co-worker's wife who has a working visa and is waiting for AOS, my intention is also is not to say AOS is faster. I am just stating the fact that visa's availability keep on changing and is very volatile.
But to say that CP "has a better chance of getting the GC's" I believe has no data to back it up. Companies/hospital who are currently employing nurses under working visa are more inclined and more persistent to "adjust" their nurses visas to GC and will use every available resources (ei: lawyers, lobbyist).
So for the sake of argument, if a hospital has a job opening for 1, who do you think the hospital will give it to? the nurse who is currently working for them or to an unproven foreign nurse who has not prove anything? My point is job offers can be cancelled, because there's a lot of nurses here who are either working on a working visa, new grad or a less experience nurse. So unlike 2-3 years ago when if you have a consular interview, your more than half way there. But now it's a different story.
On a diiferent note, Lawyers will tell you different things...if they want foreign clients they will tell them CP is faster....if they have clients who are already here, they will tell them AOS "has a better chance". At the end of the day, it boils to their business and making money is the name of the game. So dont believe everything the lawyers says until you paying them.

Attorneys do not issue visas, only the US government. It still does not matter, the issue is that there are no visas and there is going to be a wait for everyone now.
The hospital still needs to provide an updated job offer letter just prior to the interview; if and one gets one scheduled. And the employer is going to need to prove that they do not have any Americans available for the job, preference is still going to go first to an American and with the way that things are now, expect that even if a hospital has spent the money, they are going to have issues trying to prove that there are no US citizens available for that job. And things are going from worse to bad here right now, if you do not beleive me, go and turn on CNN and see what is happening as we speak.
I do not make any of the rules or laws here, but I can tell you what is happening. If an RN with 20 to 30 years of experience is getting laid off from their work, then that facility is not going to be bringing over a foreign nurse; period. Does not matter what is promised, but what is going to happen. Any hospital that is unionized is not going to be able to get around this, the unions can also block the foreign nurse being brought over if their own members are losing their jobs, and they will do that.
Do not think that it will not happen to you.

well duh....I didn't say that attorneys issue visas. All I said was with the situation now, I think it is better to go through consular processing than AOS. That's all.
Also if your employer still wants you ang gives you the offer letter, then there wouldn't be any problem and you'll be fine during the interview.

Just starting off and you will not have any of this and banks are not going to be willing to take a chance with anyone. We are having to bail out the banking industry here if you have not been reading of what is happening right now.

This lady claims to tell you the truth and keeps on repeating over and over again of her claims and nothing new about it, so please believe in her and stop bugging of ever coming to america because this is just what she wants....can't you get it!!!!

What I meant was that if your PD is CURRENT, not the EB category becoming all current. Obviously there is still retrogression and it's far from being current.
I think everyone has his own opinion on whether the dates would move back or forward.... But the truth is no one can really predict how far it would move and how far it would retrogress. I think its just a matter of waiting of the official visa bulletin.
