I am starting a new thread to track cases from NVC - embassy to GC.

The best news for RN in China, Phillippines and India has been great and informative thread, but I think it is more appropriate and convenient if we start a new thread.

Also with the rapid scheduling of interviews for most of us, I am looking beyond the CP and anticipating the GC!

The August interview schedules are out already in India, and recently in the Philippines and hopefully in China.

Again, your NCLEX exam does not expire. Just because a license does, does not mean that you need to retest. You just renew your license when you are able to. Simple as that.

As for your question Silverdagon...I took all the needed exams first before I signed up with my employer. So I could concentrate on work after.

Hi guys! Any good news yet from those who completed their cases?... My borther in-law got his GC, it was through AOS, he was in another visa when he got there(not tourist). I want to feel happy for him but he had a PD Sept. 25, 2006. I feel that instead that visa are for those in CP, he and his family had it. It's just soooo frustrating...... :(:(:(:(:(:(:(:(:(:(

I asked my agency bout my NCLEX, I took it February of 2005, and i was afraid it would expire but my agency says it wont. How true? I took the Nevada NCLEX.

Hi i took mine also march 2005 (Nevada state). Since my license will never be released not until I have my SSN, I pay $100 every year to the NSBN-nevada just to keep it current.

My best friend and her family just had their GCs, too, and their PD is October 2006. They gain entrance to US via tourist visa. I am happy for them yet sad for me and my family whose PD is Oct. 2005. I too have my tourist visa together with my family however, I was ill advised and opted for a consular processing. Now I can't go on AOS since my CP is active. I.m stuck in limbo.:uhoh3:

Things are completely different now, and have been since last year. Those attempting to go thru AOS that have just come here on a tourist visa are going to find it extremely difficult to get approval. It is in violation of US Immigration Law to do so, and especially when you come over with your family. All types of red flags are raised.

There has been a retrogression in place since last October 31 for all nurses, no matter where they are from. To attempt to scam to get in front of everyone else is just not the correct thing to do. Same as taking cuts in line, why are they more important than you? Why should they get special treatment in front of everyone else that has been waiting?

The AOS was never designed to be used for tourists coming over here, it was meant for those under different temporary worker visas and they take years to get normally. They got in lasy year and got things done under a loophole. But that is not how things are now. The burden of proof is going to be on them to prove that they did not have dual intent and immigration is following up on all of these cases now. You are going to see many denials on those that are going thru the process now that were on the B1/B2 visa.

And the other key thing to remember, they can always go back and review a case. Immigration has that right, and they can cancel a green card if they determine that there was dual intent. They are always going to be looking over their shoulders, especially the ones that did not have a job at home for them waiting, or other things that showed that they were going to return home.

So please, do not congratulate the people that have come over in the past two months and are taking cuts in front of you and delaying you. It should be the opposite, most definitely.

What happened last year, happened last year. And this is not against any of those that are getting the green card now from then.

But for those of you now that decided to take cuts in line in front of everyone else, please be aware that immigration will be watching every move that you make. And burden of proof is on you, not them. And the visa that you get, if you get it; will mean that it was not available for someone that has gone thru the correct way of doing things. And it can be cancelled by immigration.

With the green card, you are still a guest in this country. And subject to being deported.

And here is more reason of why I am stating what I am. And their green card can be revoked and they can be deported. The green card does not protect them. And the issue becomes even worse for them, it means that they provided false information to the US Government.

With a green card, they are still a citizen of your country, and are not protected by US Law in this case.

I was just wondering... if we see dates like OCt 2006 getting approved under AOS, and these are not under Schedule A and under EB3. Does this mean when the Oct. VB come out there's this big chance that dates won't be that retrogressed, probably 2005? or am I dreaming?

AOS is completely different and they have different petitions that get submitted. Actually, until there is a Schedule A or something in addition to just the EB3, expect to see at least some under the retrogression. Do not expect it to be lifted for all. And especially not now that immigration was forced to accept the I-485 petitions when there are already no visas available.

Yes, there will be some new visas released in October, but they are for everyone, not just for nurses. And there are only so many that are allotted to those from each country. So a nurse from a country where only a few wish to work in the US, will get things completed much quicker.

And seeing that other thread that is showing more than 630,000 Filipinos currently enrolled in nursing school there, the wait is going to become much longer for many from the Philippines to be able to get to the US.

It is called supply and demand.
