I am starting a new thread to track cases from NVC - embassy to GC.
The best news for RN in China, Phillippines and India has been great and informative thread, but I think it is more appropriate and convenient if we start a new thread.
Also with the rapid scheduling of interviews for most of us, I am looking beyond the CP and anticipating the GC!
The August interview schedules are out already in India, and recently in the Philippines and hopefully in China.

Hello REP and Suzanne,I am already here in the San Jose California, USA. I took the AOS route. My lawyer filed the my and my family papers (my family is still in the Philippines on April 6,2006. Approved I-140 and I-1485 May 6,2006. Got EAD and advance parole also May 6,2006. Got my green last August 18,2006. My family's pocket 3 completed last September 7, 2006 they have same priority date as mine May 6, 2006. Unfortunately my lawyer is charging me another $1000.00 to help us process the papers in US Embassy in Manila, (my lawyer is based in L.A. Ca) but I didn't agree since is was stated in our contract that consular process is included, so to make the story short my lawyer abandoned us, so I am left alone to finished this process. I called US embassy in Manila they told me to wait 4 months(Jan 7,2007) for them to give a concrete answer. My family case number is MNL2006xxx021 EX priority date is May 6, 2006. Is my family affected by retrogression even though I have my green card now? By the way I called NVC they don't have my family file with them.
Yes, your family is affected.........they cannot be on your visa as you were in the US, and they needed to be in the US to be included on your visa.
When family members are not included on your petition, and they were not, since they have to go thru consular processing, it will be two years before they will get a visa for here, at the earliest, since they are your dependents.
Anytime there is family involved, and they are not in the US with you, I always recommend that the nurse do the process from their home country as the family will be waiting longer to join them. Consular Processing should have been done for you, not the AOS route, at least in my opinion.
My family was included in the petition my lawyer filed last April 6, 2006 with my petition too as direct beneficiries of an EB immigrant. Any comment?

Then right there, your attorney did something incorrect. They cannot be included in your petition if they were not in the US and not having their status adjusted at the same time. You were given incorrect information......
So they were not included on your AOS documents. And if they were, they were not processed, because legally they cannot be if not here.
As I stated above, it will be at least two years before they will be able to join you here. Same thing as what happens when some agencies tell the nurse that they can just have the family join them when they get settled and they are never on the original petition to be submitted, it is two years.
Your attorney gave you incorrect information, but that will not change what USCIS does.

I-140 processing time is almost the same for three service centers right now, but not in last year after the lifting of retrogression. there is nothing wrong with the file, attorney or petitioner but processing delay. By the time the documentarily qualified file was finished in NVC, no visa numbers!

I called NVC to inquire about our MNL case but they told me no file there they suggested that I called US Embassy Manila, which I did. I was informed by Manila US embassy that my family papers are line up for interview and just wait for next release in December of Pocket 4. I also inquired if we are affected by retrogression, the person whom I spoke with told me that WE ARE NOT AFFECTED BY RETROGRESSION since we are EX category. I hope he is telling the truth I paid $18 just to talk to this guy( so expensive, no more is free in US embassy in Manila everything is business).

Did you pay the visa fee bill of your family?

Sorry, but wrong information, we are talking of the I-140 and that only. Visa numbers are not issued based on that, but after approval of the DS-230...............the I-140 is only the very first step in the process.
And why is there are procesing delay? If the file has everything that it needs, then it is completed and there is no delay....think about it. Usually it was a document that was not submitted in the packet by the attorney or incorrect information given to the attorney by the petitioner, or even just verification that the job was posted for ten days and a thirty day wait. Can be as simple as that.................
Why would something get delayed if it was complete? What if you are the person in that office, if you have a complete file that meets eveything, then you stamp it complete, if it is missing something, then you need to contact the person/company that gave you the documents to get what you need, or you deny the file and send it back. You do not keep it sitting on your desk growing old.

If you were process separately that could mean that their visa fee bill have not been paid yet. I think you can get a lot of information from the NVC than the US Embassy since it is the NVC that does ther visas processing and the interview schedule. Just my opinion. You can email NVC regarding this and I am sorry i forgot the email add of NVC. when yo9u write NVC please include your case number.
