This is my first job as an RN. I work in NYC for a homecare agency.

They told me there are no RN cases so I would be getting paid

as an lpn at 20/hr. Some of my lpn friends are getting paid 23/hr

as a new grad. so, already not too happy but beggers cant be choosers.

The only homecare case I have is a 14 month old boy.

My job says that I work 7days a week, no days off, no holidays,

no benefits from 8am-4pm. When I received my first paycheck I also noticed that they

didn't take any taxes out. The baby doesn't really need much of my nursing

care. Just g-tube feeding, diapers,meds and bath. The rest of the time

i feel like a babysitter.

In the beginning the mom would ask me to do some laundry and

vacuuming and when she noticed that I would ignore her requests she

got the message. But, when I had mentioned it to my boss, the boss

told me that its not a problem to help her with a little bit of house work.

what the h#ll!!! I did not go to school to clean homes and to be a babysitter!

Where do I draw the line? The economy is terrible and no one is hiring new

grad RN's. I am sooooooo tired. I just don't know how much longer

i can do 7days a week. Once in a while I request a couple of days off, but

I only get 1 day off a week, if possible. It also takes me 2 hours to get to work and 2 hours to

go home because of nyc traffic.

So I need input and advice from people who know how to handle

this situation. I am obviosly desperate for work. I have a 2 year old son at home

to support who i barely get to see. I feel like Im being cheated by the

agency and a bit taken advantage of by the mother of the baby i take care of.

I was never given a job description. There is just so much playng I can do with

a baby. I feed him, bathe him, diaper change n play. But god help me if the

mom hears her son crying. She thinks im not doing my job

How long are you planning on staying there for your resume?

If the agency is not taking out federal tax, they are also not taking out medicare and social security.

The medicare and SS is a percentage of your pay, the agency pays half and you pay half.

I do not know how it will affect you by their not taking the medicare and SS out, I don't know if the agencies will come after you or not for the amount that was not taken out.

Maybe someone with some tax knowledge could clarify that.

I would think about reporting the agency to the IRS, because it sounds like you are an employee and not an independent contractor.

There are jobs in upstate for you and for your husband, here is a link I found--check it out. They are looking for firefighters in upstate--as of 4/09 they needed 44 in Syracuse--can't imagine all those slots are full! lol he can find work and so can you--and keep your license. And they do hire new grads for REAL jobs....don't worry about just getting anything on your resume.

I feel a bit more empowered. I feel more confident to not be scared in voicing my concerns with my agency n the mother of the child i care for. You are all correct! I don't have to put up with it and it's not worth losing my license.

When I worked 7 days a week, I was making overtime, which went a long way to pay my living expenses. You do not want to work for an agency that does not follow labor laws, although there are a lot of them out there. What you should do is to continue looking for another job until you find one.

I think the most likely explanation for your situation is as follows:

It's an insurance scam on the part of the mother and the agency. Mother's insurance is willing to pay for 7 day per nursing week care for her "disabled" baby. Mother wants to take advantage of this and get what would be a nurse, nanny, and housekeeper rolled into one, because her insurance will pay for it. The agency is billing the mother's insurance company for your time at WAY more than $20/hour and making big money because they pocket the difference. The agency is using you as an independent contractor, not a real employee, because if you were an actual employee they'd have to pay you overtime and benefits. If I were you I'd quit and find something else, because it's going to be hard to make this job look like real RN experience on your resume (plus the fact that they're taking advantage of you!)

I wish I could move to upstate ny. My husband is a nyc firefighter so our home is nyc.

I would like to give more details of medical issues with baby, but to be safe the main concern

is his g-tube. baby has no life threatening issues. The mom lives in a beautiful duplex apartment with many bathrooms and many bedrooms in nyc. she knows she is playing the system. she told me this herself. she is on medicaid (idk how!)

But as my agency told me, its not of my concern why she has a nurse.

So I start my day off by preping babys meds(simple meds such as vitamins, prilosec etc)

in syringes PO.

Mom is usually sleeping in her bedroom. She leaves house door open.

Baby is crawling around the house. no baby gates (not even for the stairs), no electrical outlet covers n she leaves all doors open all day. One morning I walked into the aprtment n found baby playing with the toilet water while mom was sleeping!!!!! n i somtimes walk in apartment n find baby on staircase. just hanging out. mom says "baby is too careful to fall". ive told her to get gates n safety stuff. but.....she blows me off.

ok....well anyway. then i take baby, change diaper, clothes , meds n feed breakfast.

then we play games. then i prep gtube feeding n take baby in for nap n run gtube feed.

baby naps 1-2hrs. then change diaper, play n then oral feed. then bathe baby, dress n prep meds to leave by moms bedside to give to baby at night.

sometimes i watch her other kids while she goes out shopping n errands.

I am contemplating on telling my agency that I wont go into work until the mom gets a baby gate n baby proof that home.

Errr...Are you saying mom doesn't even work? Am I getting this right, she's using the system to pay, not for a nurse to look after a severely disabled child, but for a full-time babysitter? While she sleeps or shops away her day?

Please, battle it out for a little while on your husband's salary and report this woman for fraud. And while you're at it, report the agency for breach of labor laws. Um, and they're a home help nursing agency? And they placed you as a childminder? Seven days a week? Surely there's even more issues there? Are they a nursing agency or are they into domestic placements as well?

This "mother" is lazy, neglectful and uncaring of her childrens' safety. In fact, why not go the whole hog and notify your local Child Welfare?

I am certainly not a nurse yet but this situation sounds just terrible. I would most definitely look elsewhere and get out of there. There are many other jobs in NY for you and your husband that will not risk you losing your license. Good luck and I hope that you find work elsewhere!

Oh my goodness, I can barely sleep when there IS a nurse and could never sleep when there wasn't. And my other children have a babysitter if I have to leave, the nurse is not responsible for them.

And I have to agree with these experienced nurses about fraud. Do you know what it's like to get that many hours for nursing care approved through Medicaid? We go through this HUGE certification process every year and the number of points you have must reflect the nursing hours granted. They look at everything (number of major interventions, number of times suctioned per day, number of ER visits and PICU admits, length and times of feedings, therapy needs, how complicated meds are, etc.) to determine this number.

I know you don't want to move and I don't blame your husband for not wanting to leave FDNY. I was a FF/PM for a long time in a big city and it was AWESOME! But there are other cities that pay FFs well and and have facilities hiring nurses to do the jobs that they were trained to do, that ensure they are working a safe number of hours and are completely on the level.

I am def starting to put all the pieces together. The mother doesn't work.

The agency did mention to put alot of writing for the nurses notes.

Which I do to cover my *** by stating things like parents refused

to baby proof, etc. I don't even know if that's good enuf.

My paycheck doesn't look like a regular paycheck. It looks like a personal

check with the homecare name on it. That's it. No pay stub.

Is this agency even legit? And what is their reasoning for not paying you overtime?

Have you researched this company at all? I wonder if they are operating above the counter at all?
