Sorry to say that if your case is really under Nebraska SC, it usually takes 8-12 mos. or so. Even Texas SC w/c is known to be the fastest among all service centers is taking 6 mos. to process the I-140s now.

Have you tried contacting Nebraska SC directly and asked why? You should. Are you even sure that this was still the original petition?

Many people who use agencies to file their I-140s sometimes do not know that their original I-140s were already adjudicated and denied. Their agencies do not tell them that it was denied and just re-filed another one w/o their knowledge or there was an RFE (Request for Further Evidence) that was sent and your agency hasn't responded yet or something went wrong that your agency and/or lawyer is not making you aware of.

Nebraska is currently already processing I-140s w/ cut-off dates of Nov 1, 2006 and personally know people who have Aug and Sept. 2006 PDs under NSC that had their I-140s reviewed already.

if you have been waiting that long for approval, you can bet on it that there were problems with the initial petition that was submitted by the attorney.

suggest that you contact the attorney after the holidays to follow up on your case. if things were submitted correctly the first time, you should have had approval the beginning of this year or even last year. something was definitely missing or it was denied and your employer filed for a second time or something was missing. either way, you should have been notified about this.

red flags should be going up as a warning to you.

Did you consider the time zones ? You might have called after office hours or they are still out for the holidays. I'd try again on th 1st working day of 2008.

Suzanne they are all up in my head(red flags) and what makes it sooooooooo hurtful is that I get no correspondances from the agency, so I count it all lost and it is now time to move on. That was two wasted years of my life that can never be regained what began as a 6months wait turned into a night mare
