Would you please explain what does actually "adjudicated" mean? In my case, I have sent them requested documents such confirmation from my hospital that I has been working there and for my husband: his medical-TB skin test was not checked. we sent them back in time, now the they say it will take them 60 days to give us update. It has been almost 60, so I called them directly to Nebraska SC, they said that clearance check done (fingerprints and name check) but there are no visa available. So, as I understand, there were no visa assigned on the first place. But why that they open the case?

Adjudicated means that a decision has been made or a case has been settled. Quite different from just being processed.

I really don't know what you mean by "there were no visa assigned in the first place". There were visas given in the whole of July when the USCIS was forced to make it "Current" even if they wanted to take it back because they made a wrong estimate. Some GCs were only able to reach the month or 2 after but nonetheless reached the applicants.

If your files were filed before retrogression then you are suppose to get one (GC) and should have gotten one already if only there were no RFEs. Now, unless they specifically say to you that they can no longer proceed with further processing of your case then you can presume that there was a visa number reserved for you but if they specifically said that there are no more visas available after your case was processed then there are no visas to be given. Like I said, all visas are suppose to have been exhausted already unless you were reserved one. It happens all the time and esp. to those under Consular processing. Cases can be documentarily complete but if it so happens that when it was only finished when there are no more visas available then they cannot give when they have no visa numbers to give anymore. If that what they said to you then you won't be receiving a GC. Your lawyer should be on top of this and let him or her explain it to you further for the details.

As to when will GCs be available again is everybody's guess. That is what the monthly Visa Bulletin is for. Cases whose Priority Date falls before the cut-off date indicated there (EB3 for nurses) are the ones who can be given GCs. Right now (Nov. 2007 VB), it is 2002 for some and 2001 for most.

I guess I will call them again and ask them specifically if there is a visa number assigned to my case. If there is one, then life will get better :). And I hope b/c I filed before retrogression started I got one assigned to me. For some reason, I had a guess that not everybody who had filed before retrogression started, got assigned visas; and NSC just open cases, work on them and than put them on shelf until visa are available (my lawyer sounds like that). I will check and let you know.

Actually, almost all got it. All the way up to those who filed only on the middle of November 2006 (it was originally set Nov. 1 but USCIS gave a couple more weeks since there were some leftovers that were found) in fact or the very last days that an AOS can be filed as there were many that gave their testimonies here during those months that that they received their GCs even if they only filed their I-140 and I-485 on the last days that it can be filed before retrogression.

However, there are no testimonies posted here as of yet for those people who were delayed because of pending RFEs. You will be the 1st one to report if ever and I do hope you post it here, whether it's good news or not. I know there are those who still don't have their GCs but it is because of a pending RFE as well. You guys should have gotten a GC already if only your files were complete the first time around. Now, we'll know if a visa number was reserved or not for those who were suppose to get one if only there were no RFEs.

Coincidentally, NSC is much slower in processing things over-all compared to Texas SC.

Yes, the deal is RFE. We'll see what they have done to our cases. Logically, if they assigned visas to everybody than RFE should not change anything.

ALso, I looked up dynamics in Visa Bulletin, and it takes 2 years to move up 9 month. So, with retrogression of 5 years, it will take probably more than 7 ? or 8? And how all the numbers were current for years and suddenly at the end of 2005, they retrogressed 5 years? b/c they changed procedure ? Sad story ahead, anyway.

if you guys were not reserved a visa number then it may be long while if we are to follow the current immigration system. most cut-off dates on the the current visa bulletin is either 2001 or 2002. the visa bulletin is dynamic. it keeps moving forward and back wards every time depending on the situation and visa availability. just in july 2007 it was 'current' for almost all employment categories, then the month after it retrogressed for 5-6 years to 2002 and 2001, respectively. try and have a look on the archive and you will know what i mean. the nov. vb indicated that some categories might move forward a bit but they couldn't say by how much and w/c countries. people will have to just wait for the next monthly vb to know that. the dec. vb is slated to be released by this week as it is usually posted every 15th of the month (+/- 1 week). if the next vb moves forward or even backward then that 5-6 year time frame will have to adjust as well, accordingly.

I told them that most of the people who filed before retrogression got the visa numbers which they answere "well, there is a chance, call us back in 30-60 days. Tere are thousands of applications." Also, as I understood they do not see it on their screen? Just a frustration.....

When they said that there are no more visas available is correct but the way the one who responded to your call has responded means they are still finding out if a visa number was reserved for your case since you are suppose to get one if only not for the RFE. If there is none then can't proceed anymore. They can't give what they don't have anymore.

I talked to other lawyers and NSC call center, and after this the picture comes together:

I guess I strated to figure out all the process on I-485. It actually does not matter when you file (in general), it is important when they open and work on your I-485 at the last stage (process of making a decision). And, if a visa available at this final stage, you will get it; if there are no visas- has to wait. They do not preassign visa as soon as you file. Therefore, like in my case, which was not open before/in July when it was "current", there is no visa available at this point. B/c of NSC been so slow, I guess, those people who filed before Retrogression but their cases were not processed before August 2007, have to wait. And I do not think it is matter of RFE, it is matter when they adjudicate your case.

That's what they told me. Is it right?

In my case, they said they are sending my case to immigrationofficer to make a decision and they will let me know. I was trying to get from them how they can "let me know" if there is no visa number assigned to my case and there are no visas available at this poit.Will they write me "we approved you case but you have to wait unitl visas are current?" Sounds absurd.

They said also that I can request from them written response to my inquiry on my case.

I guess I will wait until :) officer make a decisison.

my pd date is August 22 2006 case still pending. so frustrating can any one post the the # for nsc please. thanks

for nurses and pts w/c does need labor certification, your pd date will be the same as the date received.

other professionals and workers will not have their pd the same w/ the received date. their pd will be when their labor certification will be approved.
