NCLEX-RN applicant in CA w/ minor misdemeanor

Nurses Criminal

Hi, I am an LVN and just graduated with my BSN. I'm in the process of applying for the NCLEX-RN. However, my problem is that I had a misdemeanor 13 years ago in 2001 when I was 19 for something petty and immature. I was of course, young and stupid, and got pulled over on the street by a police for following my boyfriend after I caught him going to lunch with another girl, so I was lightly ramming into his car with mine at a stoplight. Yes, I was that crazy girlfriend, but I am not that person anymore and I have never been in trouble with the law since.

Fast forward to 2008 when I finished LVN school when I was applying for my NCLEX-PN back then, I went through this whole process of writing them a letter explaining what happened, included a police report with the misdemeanor, and even got the whole thing expunged at the county court. The board dismissed my misdemeanor and I was able to take and pass the exam and obtain my license. I've worked as an LVN without any violations and my license is in good standing.

My question is this: Am I required to disclose the same misdemeanor and go through the whole process again, delaying my ATT? I would like to take my exam as soon as possible without any delays. It's already been expunged, it happened 13 years ago, and the board already knew about this when I became an LVN. Will this show up on my record when I do the live scan fingerprinting? Does anyone know? I'm from California, btw. Thank you in advance for any help or assistance/guidance provided! I appreciate it!

Yes, you will need to disclose this again and you were NOT a minor, you were 19-years-old which is an adult.

Specializes in L&D, infusion, urology.

It will show up on your LiveScan.

Thank you both very much for your input and replies! I went to the court today to get a certified copy, $28 plus $0.50 per page to copy, which takes 5-10 working business days. Thanks again for your help!

Hey there!

I am from California and just got my RN license in november. I can relate to your frustration with having to release that information to the BRN and your worries about delaying your ATT. I was arrested a little over a year before I graduated from RN school for Driving recklessly but obtained an attorney and had the charge dismissed. I only received a speeding ticket instead.

Anyways, if I were in your position, I would most definitely disclose this information because you don't want to give the BRN any reason to believe that you are a dishonest candidate. You will be fine since you were already cleared for your LVN license. Compared to the other students of my cohort, my application took about 3-4 weeks longer because of my disclosure.

Nevertheless, I would take a little longer wait for my ATT over potentially being denied because I though I might not need to disclose something in my history. I hope everything works out for you and good luck!
