My Agency Doesnt Pay Night Differentials..

Hi

I am Agency Nurse working in one of the hospitals here in Memphis, TN.

My agency says their contract with the hospital doesnt include night and weekend differentials and any other benefits so what we earn is just basically $21/hr no more no less.

Another policy is that overtime will not be counted if we work less than 1 hr 45 mins over our 8 hr shift

is this legal for the agency to do this?

Does anybody have the same situation?

Any advice?

Many agency pay flat rates as far as no diffs for W/Es or Night shift. And to my knowledge there is no federal law mandating extra pay for W/Es or nights.

As far as OT, in most places you have to work more than 40 hrs in a one week period before OT is given. While a few states mandate time and half after 8 hrs, to my knowledge, there is nothing in federal law about this.

$21 an hour? Is that RN pay or LVN/LPN pay? I would not get out of bed for that little of money for RN and would take a hard long look first before getting out of bed for LVN even.

As for diff's, Most agencies do not give diffs for nights. The rate generally is higher for working nights or weekends but it is a flat rate. Overtime is discouraged as an agency nurse. You are expected to be done on time and leave the facility grounds at the end of your shift. You start working late to complete your job and a facility more than likely will make you a DNR there.

no shift differential, evenings and nights got the same rate as days

hourly rate for RN was $26 then went to $27 an hour

another agency was paying $28 an hour

I think it was a dollar more on the weekend

we got paid the hourly rate from when we clocked in to when we clocked out

I would not work agency for 21/hour in Memphis if you are a RN. The local hospitals pay that and more.

Im actually ok with 21/hr BUT with no benefits, strict overtime policy its just very inhumane esp sometimes you are so toxic with 10 patients.. Yeah if only I have a choice to resign.. but Im still more than 2 years in our 3 year contract and our breach of contract fee is about $45,000..

Im looking at complaining with EEOC..

Are you actually a foreign nurse that they petitioned? Since there seems to be a discrepancy with pay in that area, and that could be the reason. Each agency has their own contracts directly with a facility and usually no two are alike in most cases.

With a three year contract, there is more to the story than what you are posting. Can you be more specific? And this is not about specific agency work as we call it in the US where you are working per diem for an agency, and it is never with a contract like this. That is why I am asking these questions to be able to give you an answer. And especially with that cancellation fee, I almost can guess as to which agency.
