Hi Libra My suggestion : GO LOOK FOR OTHER AGENCIES.. That will be goodd for you. I totally agree with pinkroyalty18 on her comments about Guardian Healthcare.. Their contract is TRULY one-sided no more no less.. I know of dozens of nurses who were hired by this agency and are now in TN working like Carabaos (Filipino term for "elbow-grease" or working hard) and NOT being compensated as promised. Theye tend to replace your contract at the last minute before the US embassy interview.. In their experience the initial contract they signed (2 years before the interview) has $15K as penalty. Then just before the US embassy their changed it to $45K plus other fees.. If you go over their contract carefully its really one-sided.. its always in favor of the employer. Also their scheme is really tricky.. The nurses remembered that before they ever signed up, their were promised of night differencials, bed side burse rates, free insurance etc.. and yet when they arrived here in the US none of those were given.. So I suggest before you sign any contract be sure to read through it and if possible let someone else who is knowledgeable like an attorney to go over it and be sure to "read between the lines". There may be clauses that are vague.. If they promised night differentials, bedside nurse rates etc.. verbally or thru some flyers, be sure to let them include those in the contract.. because that is what happened to these nurses.. Anyway if you need further info about guardian healthcare providers just let me know.. In fact I discourage ALL FILIPINO NURSES to sign up with this agency that takes advantage of our weaknesses when it comes to nursing . There are many many loopholes in their contract and system. Pls look elsewhere as there are dozens of other agencies that over Full benefits and dont charge exhorbitant breach of contract fee .. $45,000 is just way too ridiculous!! Its obviously punitive and a way for them to hold nurses "in the neck"

How is your Breach of Contract Fee?
For nurses who have contract with their current employer, I appreciate your input. I would like to resign from my current Employer which is a Nursing Agency but my cancellation fee or breach of contract is equivalent to 1-year gross Salary which is atleast $45,000 .. this doesnt yet include according their contract the fees they incurred during the immigration process etc.. so more or less we projected this to be about $50,000.. We are very upset about their system which doesnt protect and take care of us nurses so Im on a end of the rope now and going to resign.. So do you think this fine is just enough? How much then is your breach of contract fee? (I heard some or my nurse friends.. some of them are around $5,000, $10,000 but not more than $15,000) is my nursing agency being reasonable? Im actually ok with 21/hr BUT with no benefits, strict overtime policy its just very inhumane esp sometimes you are so toxic with 10 patients.. Yeah if only I have a choice to resign.. but Im still more than 2 years in our 3 year contract and our breach of contract fee is about $45,000.. Im looking at complaining with EEOC.. thanks for your posts

My Agency Doesnt Pay Night Differentials..
Hi I am Agency Nurse working in one of the hospitals here in Memphis, TN. My agency says their contract with the hospital doesnt include night and weekend differentials and any other benefits so what we earn is just basically $21/hr no more no less. Another policy is that overtime will not be counted if we work less than 1 hr 45 mins over our 8 hr shift is this legal for the agency to do this? Does anybody have the same situation? Any advice?

Hi All Im actually the thread starter... First I just want to let you know how much I appreciate your advices. esp. that of Suzanne's. they are all well thought, well researched and learned from a reliable source.. thanks for sharing! Update : Now It's been almost a year since I asked that question.. Im happy to report that after that long 'struggle' Im am now happily residing in the US with my wife and child Josh. I have decided not to pursue that Canadian Dream since like what you folks adviced its impractical and costly among other many reasons.. in my case I mean.. (Im not saying Canada is not good.. I would not have applied to it in the first place if I didnt consider Canada a very ideal and liveable country!) What I can advice others here is that you have to stick to only one country esp. each of these countries (Canada and US) strictly follow their own policies and are very much concerned about loyalty to their own government esp. complying your obligations and responsibility (e.g., taxes,length of stay etc...).. Each of these 2 countries have their pros and cons... but whichever country you decide to migrate be sure you have thought and researched a lot about it. The key is first to know your priorities in life.. For me its my family since we would be together if we have chosen US.. Now we are thankful we have made the right decision!! Hope it's ok with Suzanne.. But Im pasting here her reply which I thought was really helpful advice: Hope this helps you guys :)

Immigration to Canada from the US--time frame question
Hi Im know this is not the right thread but I can see that people are knowledgeable in my issue Im from the Philippines and my wife (principal applicant) is currently applying as immigrant for the US. So I fall as a dependent. We presently are just waiting for an interview at the US embassy. However prior to my wife's US application, I have a pending application as Immigrant to Canada. In this case I am the principal applicant and my wife is a dependent. My case book is already filed at the Canadian embassy but I keep receiving mails from the Canadian Embassy that I need to update my forms, certificates etc. for my application to move forward. But since my wife has applied for the US I just ignored the letters from the canadian embassy because I decided not to continue with it anymore but chose to work on that US immigration instead.. But our US application has been delayed due to retrogression of visas, I now think of continuing my application for Canada since I thought that maybe we would leave for Canada faster than US. So my question is.. Is this what Im planning legal for both US and Canadian Immigration laws? Or is this possible to have both US and canadian Immigration application? Pls let me know..
