I was just wondering if anyone has been successful in litigation against The College Network, or maybe you know someone who has? If so please post the experience. Thank you!!
ISU is not directly affiliated either. If you call their admissions office and nursing department, they will tell you to RUN in the opposite direction!
Hi "medsurgemess", I called ISU phone number yesterday(I'm sure that is ISU, not TCN), I was surprise that they said I "HAVE TO" join TCN because I'm in California, I tried to ask more question, but sounds like she is pushing me to contact TCN too..... it's not like ISU ask you to run away from TCN, why????
Besides, I read hundreds posts about all the bad experience with TCN, and I totally believe that i don't need TCN to get into ISU program. So I just registered with ISU myself and find out which class they will credit or not. I will try to wait until the evaluation of my preq. classes first.

i wanted to know how did your court case go?....what happened?Mehn dis school or bizzness needs to be shut down....am thinking about taking it to court too.....and it's funny because, they wont even try to meet you half way and reason with you!!!!!!
Why should they try to "meet you half way" or "reason with you"??? You signed a contract agreeing to pay them for their product, exactly the same as if you finance the purchase of a car or any other large purchase. It's a legally binding contract. If you change your mind about the purchase later on or have difficulty making the payments, that's not their problem -- legally, you owe them the money, and that's that.
I'm not saying this because I'm any kind of fan of TCN -- but people need to take responsibility for informing themselves about what they're getting into when they sign contracts, and take responsibility for having made the choice to do so.
I just recently been sucked into TCN program. And then my friend told me about all the negative comments written about them. After my research I have found that they are telling you that they are affiliated with Excelsior college when in fact they are not. Excelsior has nothing to do the TCN. I live in Florida and was told by my couselor that I would be able to take my boards here in Florida. Thats a lie. I have found out that I will have to fly to Gorgia and that Florida will not accept my license. I asked my couselor and he assured me that I could take my exam here in Florida no problem but he lied! I have also done research and found in my state it is against the law if it is determined that the contract was signed under false pretense. This is definately the case here. I was told that both I would be receiving a degree in nursing with an affiliated school and that I would be able to take my boards here in Florida. So yes I do have a lawsuit.
I would like to know how the other girl is doing with her lawsuit? Have any of you had any luck with one. My next step will be to contact an attorney but I need to stop payment on because stupid me gave them a blank check. I know they will come after me and put me in collection. So what let them I have no money to give!

What you need to keep in mind is this:
You do not have to fly to GA to take your boards. You do not have to be physically in the state you are seeking licensure in when taking the NCLEX. You can be at a testing center whether in Miami, Gainesville, Ft. Myers, or Jacksonville for that matter and be testing for an RN license in Alaska or what have you. You can test in FL for a license in any state. It's the same test in all states.
As for your financial obligations to TCN, you could get a lawyer and sue them, and probably win if they told you that you would be eligible for a FL license when in fact you would not be upon graduation from EC.
However, the legal costs and time in court alone would most likely not be to your advantage. I really wish that a big group of you would do this as a class action lawsuit. This would be to your advantage and worth your time and effort. I believe that there are are enough people here on this website and thread alone that are in the same boat to execute this.
But at worst, the money you owe them is unsecured debt and all they could basically do is call and harass you for 7 years. Like you, it would not be enough money for them to take you to court considering time and court costs so that is why they would employ collection agencies in an effort to scare and intimidate you.
In 7 years max, the debt would have to be wiped off your credit record, paid or not.
I have read that TCN has sued, won judgements against people, and was able to seize their assets. TCN does not let you get their study guides for nothing.
Interesting considering that their study guides are unsecured debt. I wonder why all the people who have walked away from their Visa/AMEX/Mastercard/Discover debts have not had been sued and had their assets seized.
Most credit card companies today are willing to to settle for less than what they are owed because you can't get blood from a turnip.
Unless your debt was secured by your house or vehicle, they can't take your house or vehicle away to make good on the debt.
I'm trying to figure out what assets TCN was legally able to seize from people. If you didn't put up your furniture, car, or home up as collateral for those study guides, they can't take it even with a judgement against you.
The individuals stated that the judgements were served against their bank accounts. I read about these situations online but do not remember the exact sites, it was a long time ago.
OK let's take it down a notch for those who are not familair with the civil litigation process:
To sue someone in a situation such as this and retrieve actual money from them, you need their bank account information because that's basically all you can do to retrieve your judgement in an unsecured debt situation.
I'm blindly guessing that the people who TCN has been able to successfully seize money from were stupid enough to keep their same bank accounts open, and keep money coming into those accounts, that they originally gave account info to TCN, for payment of their study guides.
If a creditor has your bank account info, then they can take money out of it with little effort.
Sigh, I guess that's why people need to pay lawyers. But with a little effort in research, it's really not that hard.
You just need to get out of your nursing comfort zone for 2 minutes and admit that you are not the expert in this area and need to do some research.
I too have fallen victim to this scam. They paint wonderful pictures of how convenient and easy their 'study materials' are, however they forget to tell you that there is no way to stop getting them. I'm frustrated because after receiving my materials, I had a child and now have two children and it's very difficult to try and find the time to study when I have a toddler and infant to care for. A physical classroom environment is better suited to me, where I can directly ask all the questions I want. I'm so irritated because I'm paying $164.00 a month (better yet, they're TAKING $164.00). I feel even more horrible for the individuals who are paying more. I attempted to call them twice about discontinuing service with them to no avail. They continue to tell me that I have to pay the money and there is nothing that can be done other than to pay off the remainder of the loan. I suppose I will have to drive on through this because I cannot allow my credit to suffer as a result of non-payment. People like this should not be allowed to operate, because they really are scamming people. What's worse is that I had to purchase my books for the college I'm attending now (I can't use the stupid binders because the information is chopped up from many texts) and sadly all fifteen books I needed were purchased for little over a thousand dollars (they were all brand new). If I would've known I could just buy the actual text books for 1/10 the price they were charging, I would have never agreed to their service. I wish there was a way to publicly put them on blast to make sure that people REALLY know what they're getting themselves into. If anyone else makes some progression with trying to cancel or recoup their losses, please let me know!

I was researching TCN when I read about how TCN was able to seize their money when they won their lawsuits, so why you insist upon jumping my "expertise" I don't know. I never claimed to be an expert on anything, I only reported what I had read. I will leave the "expert" status to your posts since you are so inclined as to denigrate anything anyone else has to say about it. I doubt that those people you refer to as "stupid" would like that comment any more than I care for your implications about me or something I have to say.
Ashley, I am sorry to hear that you are also in this situation and would advise you to seek advice from an attorney that practices law in real life.
Thanks for the support. I too am in the military and will try the route that mdhammons did by going to JAG, but I was surprised that they were willing to back up a civil dispute. If that doesn't work, I will probably contact my parents attorney to see what can be done. I will be sure to let anyone know what results, I'm hoping it's better than my current situation.
