I have a DWI arrest from ten years ago,(dismissed) and recently got arrested last June and charged with a DWI (pending). I have court this June for this 2nd charge...I recently received a letter from BON stating that they wanted me to take two tests MPI and a SASSI evaluation. i sent them the paper work aggreeing to such tests. I have not heard from them. I am very frustrated, because I am not an alcoholic...Just made irresponsible choices, well this second time I was not drunk I was very tired and fell asleep for seconds at a red light stop....anyhow my ??? is I am planning on moving to AZ, I would like to pursue my Nursing education, will I have to go through same steps with the BON in AZ...??? Am just wondering, or should I go for my BA in Health management????please share your thoughts...thank you:confused:

A BA in health management will not be much help for entry level employment. I would direct your questions to the AZ board, but if I were a betting person, I would bet that you will encounter problems with a recent arrest on your record.

I dont know how you can get a DWI for falling asleep, didnt they do a breath-a-liser (sp?)? Anyhow, I think you need to contact the BON, theyre the only ones who can truly give you the facts. MUCH LUCK to you!

I refer you to the movie Liar Liar and the scene where Jim Carrey's character was giving some sound legal advice to one of his clients once he(jim) was no longer able to lie......
It was a funny movie, but the advice was sound....
Because I did admit to having been drinking, but i was not drunk, I had been up for almost 24 hours....

Sooo...do you have a breathalyzer result proving you were not legally intoxicated?
If you were up for 24 hours and made the decision to drink anything and then get behind the wheel, that was a serious lapse in judgment. Sleep deprivation is known to exacerbate the effects of alcohol. I would be willing to bet you are going to have to own up to that lapse in judgment in a big, remorseful way if you cannot prove sobriety with either a blood test or breathalyzer result. If you refused to be tested, I think you may have slit your own throat as far as your BON is concerned. Of course, each BON has their own "personality" with regard to how they view various offenses, so it really will be state specific.

From what i've learned, in TX a nurse can agree to rehab and after they successfully finish the rehab, their record wont become public. You probably have a restricted license, but you will still be able to practice. Even if you transer your license, you will have to let AZ BON know of your restriction and you probaly will have same restritions as before
