HR lied to Unemployment!!

I was suddenly brought into my managers office one am a month ago and told that HR was drawing up termination papers for me. She said I might want to think about resigning ... if I do I could work somewhere for one year I be rehired at the hospital. I mentioned that I would try to get unemployment since I am the wage earner in my family.

My husband has just recently been diagnosed with early onset Parkinson's disease. She said the hospital would fight me on that...So I applied and was awarded. DE only pays $320/week..period. But since I did some agency work I never actually was paid anything. So last week I get the denial from Unemployement with my EX employers statement. They said I was never told I would be terminated..and I left on my own accord.

I don't want the money ... it's not enough to pay my bills...but what would You do? ESP. Since I don't know what my EX employer is telling my new prospects when I am called for interviews.

You need to appeal because you need whatever help you can get for you and your family. They wanted you to resign so they wouldn't have to pay unemployment. If you give in without a fight and let them take unemployment from you that you are entitled to that doesn't mean they'll give you a good reference! That is not how it works and I doubt they would put you as a rehire just because you resigned when they wanted you gone in the first place. It's just a lie they told you to save money re unemployment. Appeal this and get all the help you can and you are entitled to!

Thanks! I'm so torn in two directions. I've done some work with an agency so I won't get any money for those weeks anyway. But I've had no work last week and only one shift this week..so I would get something for these weeks. Pretty hard to swallow only getting $340 a week when you're used to getting $1000 /week. So it won't pay my bills...it's almost more about the slap in the face of the lies..

Did you do that check to see what kind of reference they are giving you?

No..I mean I'm sort do afraid that if I fight the unemployment denial before securing another job that the managers won't give me a reference. I have had two interviews to date..and have been told by both hospitals that until I get at least 2 references from managers that they can't offer me the position. So I gave them a few new names today. I'm afraid that by fighting it now...they'll def try to screw me. Should I wait?

If you are denied unemployment, fight the denial with an appeal. Look at the booklet that comes along with your unemployment information for information about appealling. Don't be afraid of fighting and you have the right to apply as well as appeal. If your former managers or the company get upset with you or tries to "screw" you, that tells you something about the company and you should feel happy you do not work there any longer.

As far as getting 2 references from managers, I can't comment on that. However, if you feel you are getting a poor employment reference when an employer calls your former company, have some friends call and ask for informantion and references. If the company is smart, all they will say is you did or did not work there. They will not give out any other information even the salary because giving out information or making an unsavory reference has come back to haunt them. Former employees have sued and won against companies who issue unfavorable references. The rationale is this: courts have found that the former employee has no control over the reference and the company can easily lie or be punitive when there is no basis for the unfavorable reference. Smart companies/corporations will give out minimal information to avoid the issue of being punitive.

This is not an attorney issue; it is an administrative issue. Normally, attorneys are not involved. If denied UE, you would appeal to a commissioner. Now, if the company slandered or liabled you or was punitive, they broke the law and an attorney could represent you.

So after being told by a hospital I interviewed at that I needed to get 2 management references from my last job; I contacted a few people who I Thought would give me a reference. This woman was one of our Nurse Educators. I thought that was a management position..but apparently not?

And whats this BC about not giving out professional references per CCHS policy>?????

So I willl never again be able to work in a hospital again..because of this?

I am very sorry but I will not be able to complete the reference for you. The form has me listed as your manager and since I do not work in a managerial role I do not want to misrepresent myself. Also I am not supposed to give professional references per CCHS policy. I am really sorry and wish you luck in your job search.

Well I didn't do anything about the unemployement..Yet. Right now I'm getting one shift per week which is paying me more than $300..so I won't be eligible for any UE pay anyway.

BUT on the bright side, I was offered a part time job on thursday and accepted it. And its in L&D..so I'm Over the Moon.

Best to shake off the dust from this and move on. Thanks for all the input!!
