I very confused and need some advise.I have been a nurse for 12 years and feel like my career is over.I had been warned by fellow nurses to be careful when doing home health contracts.Well I did not take there advice and ended up in a big mess. A employer that owned the agency was in trouble with the law. was unaware.I told her I could no longer work 12 hrs a day 5 days a week it was killing me.She stated if I quite she was reporting me to the state board and she would find something on me.She did I charted 2 different dates i did not work.I had did the days i just charted on the wrong days.Long story short I was made out to be the bad guy.What i did not know was this person was in trouble for some problems her company was having and so she was not in a good place herself.

I went with the board order because i could not afford a lawyer being a single mom I was an LVN applying for my RN 3 yrs later when the board came after me with Waring with stipulations.I now look like a harden criminal when you look me with the state board.The sad thing is I am not a criminal I have never been. I am a single Mother and a really great nurse.Its a sham people have to be treated this way.:barefoot:

I have to be honest, I really don't understand your post or what the issue is or why your license is in trouble..you are an LPN not RN but are trying to become an RN? Reporting you to the board because of two missed dates of charting doesn't make sense and I cannot imagine any BON entertaining this complaint from an employer let alone doing taking any action against the nurse. And while I've not ever had to go before the BON for any reason, I do not think a nurse would need an attorney to defend themselves or explain their side of the situation. Maybe I'm wrong about that though...

Yes its a little confusing but the bottom line is.I was an LVN from 2000 to 2008.In 2005 there was a complaint from an employer.The board stated they investigated and was going to close but when I applied for My RN in 2008 I was then accused of tampering with documents and put on 1 year probation I had to do classes and pay fines.I had a great employer working at an hospital, for the last 6 years till I became sick this year with RA this year and now I have been offered great jobs that dont effect my RA only to be let down when they ask me about the board order.So I am about to lose everything.I need some advise.Has anyone ever had something like this happen and were they able to work as a nurse ?:snurse:

My advice is to get an attorney: some cost less than others. Many will work w/ you on a pay-back as you go system. A "Nurse lawyer" would be the best choice, and they often advertise in your Board of Nursing and state American Nursing Association newsletters.

1) Ask the lawyer to help craft a letter " To Whom it May Concern" explaining this mark against your license and make copies to submit with your job applications.

2) If you are truly innocent, ask the lawyer to petition the board for a review, try to "claw back" your fines,

and then you and your lawyer can consider asking the attorney general of your state to review your case....the Board may be over-enthusiastic and a little off-base.

In the long run, an attorney should help you protect your future income and your reputation and will be worth it: $60K/yr. for the next 20 yrs.? Worth a try....just sayin'

I will try and get money together but its more like $ 275 hr with other fees as well and i have already spent $2000 on an lawyer that claimed she new how to handle this type of case only to find out i was her first.If I could get a referral from someone that would be great.I give your advise a shot.They would have to be able to deal with the TX BON.

You might contact this group who specialize in nurse's legal issues. They may be able to advise you or refer you to a lower-cost lawyer.

Nursel56 is right-on with her advice. An RN who was retaliated against in a Tyler, TX hospital was just cleared in the News!! She applauded the AANA on CBS News here after the Appeal cleared her name and license against fraudulent charges.

That's nice, I wish I would of known about that back in 2011.

I too hired an attorney back in 2011 when I got a letter from the board. The guy was from Austin and he should have not taken my case especially since he had dealt with the board only once in the past. Unfortunately, I signed a board order and till this day am having a hard time getting hired because I have an encumbered license. I have "warning with stipulations".

My situation was, I had a patient fall under my care during change of shift. He hurt his head and as a result, I got reported to my texas BON.

Since then, it's been so hard to get hired and when I do get interviewed I always get, "wow, that was excessive, patients fall all the time, but it's against hospital policy to hire a stipulated license, etc etc. We hire the BEST"

I've been unemployed for a little over a year, and have record of places where I've applied, what they tell me, and places of where I continue to apply until this day..

My advice, don't sign the board order if you don't agree with it. If you do, there is no turning back.

How long was your warning with stipulations? Didn't it fall off your license after you completed your courses?

I just got report to bon, I havent got an response but more than likely I have to work in LT or hospital showing me clocking in and out. Can a job not hire me with warning and stipulations or fire me for it. Please help
