My friend told me there is a bill allowing 7 years to be quota exempt for foreign nurses? Has this bill been passed?

I know that..I am not ignorant on how laws should be passed in a democratic country, and nobody says that Zashagalk comments were rediculous and had no base at all..As you said it depends on the mood of the congress and the senate, but what Zashagalk said was that there is no way that this bill would be granted by the Houses-and that he is just being realistic and doesnt base his life on false hopes like winning the lottery- I just reacted on what he said because I dont like it and find it irritating..period..:madface:

I don't think he is trying to irritate you.He is actually a liberal guy in terms of his immigration views. If you have lived in the US for a long time, you would realize that the politics is changing. Many areas (states) are very conservative and ANTI-IMMIGRANT. Their politicians will continue to pander to these constituents. Even if the Senate bill is unlikely to pass, there are other ways where visas would be granted. It would just take time as they have to be careful not to step on a hot potato (immigration issues). Legal immigration is often lumped with illegal immigration and the current public mood is not very friendly.

i don't claim to know all, but i highly disagree with zashagalka. for such a bill not to pass would require heavy opposition from the us nursing associations. and as far i know, there is no such thing. in fact, recent survey have shown that everywhere nurses are complaining about shortage (of course the healthcare corporations have no objections either). and it's not like we are going to graduate a lot more nurses in the us any time soon either, because there's a major shortage of faculty in the field, and even though there is interest (due you to rising demands, obviously) more people are being turned away because of this. i personally know schools where the wait time to get into the nursing program has gone from 1 semester to 3 years.

so yes, there is a good chance of this bill passing. i don't mean s.2611 as a whole would pass, which carries this provision as well as the one that allows illegals to get on to a path towards citizenship. no, that would probably not pass in it's current form, but there is no way in hell that the congress would just sit silent on the ex 50,000 visa category finishing and nurses being moved to the retrogessed e-3 category where current wait times are around 4 years. again, no way. the demand is always increasing and dragging the shortage with it, not to mention the aging baby-boomers who need medical care more than ever.

the government will pass one law or another that allows for expedited processing of foreign health care professionals, may it be exemption from limits or special categories with extra visa numbers.

please remember to remain civil to one another.

even if there is no cap, things will not get easier for anyone to get to the us. exams will still need to be passed, english exams passed, a visa screen certificate obtained, etc. and not all be able to get to that point.

and just passing of the nclex-rn exam or the cgfns exam, does not guarantee a nurse that they will get a green card. there is still the entire immigration process that needs to be gone thru.

there are quite a few that get refused in the initial step of the i-140 petition. it is not 100% approval even if you get to that point.

congress and house of represnetative members are up for reelection at this time. election will be the beginning of november, and after that is what we call a lame duch congress until the new members are sworn in during january. do not expect anything to be even considered until after that time, releasing more visas for rns is not considered an emergency here.........remember that the process to come over is not instantaneous, and requires a year or so in many cases. there are other issues that will need to be addressed before the nursing visas comes up.

this is what we are trying to tell you. none of us have crystal balls but we have all been here thru times of shortages of nurses, as well as too many. and it does happen.

I have passed all the nursing exams needed or required ( CGFNS, NCLEX and TOEFL ) for working in the US.

The CA employer hired a US immigration law firm and filed for my I-140 petition last March 22, 2006.

My I-140 petition was approved last June 16, 2006.

My next step were to pay the VISA but then on September 11 2006, my agency informed me

that there's a retrogression and my application will take a while to be completed.

What is this retrogression? How will the retrogression affects my visa application ?

How long will this retrogression be effective? or how long is the wait for my application to be completed?

Would my chance to get a visa be affected with this retrogression even if her I-140 petition has been approved?

Is there an easier way or faster way (application) to work in the US as a nurse?

I would really appreciate any help or information that

you can give.

there are plenty of threads both on here and the Phillipine forum about retrogression. No one knows how long it will last and who will be affected. If you was approved in June I am surprised that your NVC fee hasn't been paid already. I am sure other Phillipines on here have been processed with approvals after June. Have a good read as I am sure you will find your answers

You have to understand that our Senate is much more liberal than the House. Many times, the Senate includes lots of stuff in bills with the INTENT to have negotiation points in the reconciliation process. Of course, the House does the very same thing.

Most Laws tend to be, if far less conservative than the House, also far less liberal than the Senate.

It wouldn't surprise me to see some relaxation on caps. But, I think a no quota Law isn't a reasonable expectation.

I point this out because many of the local House races involve candidates scrambling to explain to voters WHY an immigration bill didn't pass THIS year. And the answer: provisions like this. I'm not saying this. The candidates that will be next year's lawmakers are.

Illegal immigration is a very hot issue right now. Unfortunately, immigration reform addresses BOTH illegal AND legal immigration. I'm afraid the one has the popular sentiment to taint the other.

Getting the I-140 approved is only the first step in the process, the visa bill needs to be paid before they will send you the DS-230. You are definitely going to be affected by the retrogression, and no one knows how long that it will last.

Even those that have everything done, but do not have a an interview date already scheduled are going to be affected, especially in the Philippines.

Not sure completely on the list to be affected, but it will at least include the countries from last time and supposedly about four more.

Nothing will be done until after the New Year with even deciding what they are going to do as far as visas, and then they do not become available immediately. When they do exist again, they will go to those first that have been in the process.

Not sure at all why your agency waited the three months to pay the bill, mistake on their part, and then you would have had a glimer of a chance, but now, none.

If you do not already have an interview date scheduled, then you are goign to be affected. You still need to have approval of the DS-230, which means that you do not even have a completed file yet. And Manila has been taking about three to four months to get interviews done from the time that the file was actually completed. There is no way that you will get in under this final run to the end.

If your employer have paid your visa fee already then you would be receiving your packet 3 by this time or in another month. I think you should tell your employer to go with the processing of your papers already regardless of what the news say about the coming retrogression. Because if there will be one, then all you have to do is wait and when the backlog is lifted you are in for the interview. This had happened to us way back in 2005, for those who passed the packet 3 during the brief backlog where the first to be interviewed when visas became available.
