Failed drug test with prescription & HIPPA Law???

I had a random drug test about 3 weeks ago. I had not heard anything, so I assumed it came back negative. I was called into the office yesterday and was told my drug test came back positive for Adderal. I have been on Adderal and only take it when having difficult focusing, but had not taken it for a few weeks before I had taken the drug test.

I was taking phentermine and I told the administrator, but she never asked for the prescription. She said the lab test showed specifically Adderal.

The administrator said that if I can show the original bottle of Adderal I could keep my job, but otherwise she will have to terminate me and call the board of nursing. I told her that I had already given them the bottle and they had made a copy of the bottle and put in my personnel file. She said it was not there.

I was told to clean my office out and she was going to call the BON!!!

I never got a call from the company doing the drug test asking about any medication I was taking. Other people in the company got calls asking to confirm medication. I thought the company doing the test should have called me and ask what medication I am taking.

I do not know if the drug company violated the HIPPA law from not asking me about the medication and just saying it was a positive test.

I am so devastated and don't know what to do!!!!!

Couldn't you get the a copy of the prescription from your doctor? As long as you had a valid prescription on the date of the drug test, I don't think there will be a problem.

How can a drug test specifically show adderal? I thought it just showed classes of drugs, ie...amphetamines, opiates, benzodiazapams, barbituates, etc.

I was thinking the same thing. Drug tests don't show brand names, they show categories.

Adderall is amphetamine aspartate; amphetamine sulfate; dextroamphetamine saccharate; dextroamphetamine sulfate, so a positive test would show amphetamines, not Adderall.

Sounds like there's more going on here. Get a lawyer..somethings wrong with this story.

I agree. Sounds like they suspect you of something. Just stick to your legit prescription and don't say anything. Get a lawyer.

I believe they are trying to find a reason to get rid of me because the company has been sold and some people will be out of jobs. We have a new administrator and she has been over heard previously that when she gets the administration position, I will be the first person she gets rid of. One of her friends, from where she lives will be needing a job. She had already started a paper trail on me and she has not been in the position for a little over a month. Puting more work on me, making me work extended hours, etc.

I have been with the company for 10 years and have a good work record. It is a personality conflict with her.

I dont know what to do!!!

i don't see a hippa violation

if you have a union go to them with all your paper work, prescriptions, letter from doctor who prescribed them to you

lawyer is a good person to help keep your license...people who threathen my license really get on the wrong side of me
