Denied employment without checking excellent references!!!!

:oMy dilemma is that I applied for a prn position as a LPN at a convenient care/occupational medication clinic. I initially had the interview with the HR person on friday1/25/08, who made me take a typing test (which I aced), took a copy of my license and CPR card, and a copy of my last years evaluation from my present employer. After the interview, which I thought went really well, she told me to interview with conv. care manager on monday 1/28/08. I went to that interview which I thought went really well. The manager talked about when I could do orientation (which lasts for a week) and we tentatively set up a week. Today I get a message on my cell phone voicemail saying that they were not interested and that if I had any questions to give them a call. So I proceeded to try and call HR and only got the voicemail which I left no message, then I called the Conv. care manager and asked her what happened and her first response was that maybe my references didn't check out. Needless to say I have EXCELLENT references. I had 3 great professional and 3 great personal. I told her it couldn't be my references, so she told me that she would make a few calls and for me to call her on Wednesday. I then called HR again, mostly because the conv. care manager seemed to have no idea that I was not the chosen employee even though I say I have great references and she even gave the okay for HR to check them all out after our interview. HR told me that the reason they were not offering me the job was "confidential". What the hell is confidential? I asked her was it so confidential that I could never apply at this facility again or what? She said yes I could reapply in the future, which I will not. During all this I remember the HR lady asking me if I knew anyone at any of the clinics and I proceeded to say yes. That was my first mistake (being honest). I told her that one of the nurses that works at another conv. care clinic was a former nurse at the clinic that I worked at. So my guess is she went to her which is a classic BI---!!!, instead of calling any of my references. I called my references after all of this and not one of them including my HR had received a call in regards to me. What the He!! is wrong with this picture? I'm hurt and angry. How can someone who noone liked at her previous job be the deciding factor in a job that I applied for? I guess my question is, WHAT THE HECK DO I DO NOW!!!!! I'm more than qualified and feel that I would've been an excellent asset to the clinic. Please help me not lose my cool and go off on someone. HR didn't do there job appropriately and took the deciding factor from a non-management ex-coworker. I'm stumped and feeling really betrayed right now. Any advise would be greatly appreciated. Sorry this is so long.

I found out today by calling all my professional and personal references about being called about this potential job. Not one of them were contacted. Human Resources at the job I applied for denied me simply on the grounds of a present employee of theres who I used to work with. The biggest issue is that she was not well liked at her last job where I still work, I never had a real problem with her, except she was about the bossiest nonempathetic nurse I had ever met. Does anyone know that if I can prove it was her comments that prevented me from getting this job can I threaten Defamation of Character? Her opinion and slander doesn't mean squat regarding my real work ethics and work record. I'm a type A perfectionist, who makes my patients #1 at all times. How can that be a risk for employment, but they will never know because they never checked any of my references. No I wouldn't work there now, but I'm not the type to stand back and be hurt and be put into political BS without getting validation and answers. Sorry still venting, but will keep you posted on the turnout of this political BS. If this confuses anyone and your bored please read the original thread.

Did you get this info from a reliable source? If you are that upset about what happened to you, by all means, seek the advice of an attorney. During my recent job search at least one prospective employer did not call my references. One of my references got incensed over this because she was taking her valuable time being available for the call. She asked me for their number and called them herself. My second reference never was contacted either. Yet, this company was running daily ads for employees. Makes you wonder.

Sounds to me that you may have grounds for some action if you can prove that this info came from an unauthorized source. You really should consult an attorney about this.

Now you know how to answer the question concerning your acquaintance with any employees of a company that you are seeking employment with. Never volunteer such info again. Even someone who you consider to be above reproach can turn 360 and bad mouth you and no one will tell you about it.

I really don't think they are required to check references. They only do that if they are actually interested in hiring you. They don't check them for every application they receive.

I think they are allowed to go on hearsay if they so choose.

If you are interested in pursuing legal action, by all means, contact a lawyer. However, you are unlikely to win unless you some concrete evidence. There is no law that requires an employer to contact your references.

A lot of employers choose not to call the references unless the applicant is actually at that final stage of the hiring process. It's not cost-effective to contact the references of every applicant. So, they do some initial screening and then focus their efforts on the "finalists." Some will only check the references of those actually hired ... and others won't check at all.

The funny thing about paranoid feelings that others might be out to get you is that you might actually be correct; or you might not.

When I was in CA, I wanted to get a 2nd PT or PRN job in home health, just to see what it was like. When I walked in, the staff was giddy. They couldn't talk to me any quicker. They were not a training unit, which I needed, so they referred me to another nearby branch that could train me. So I go to the interview and it goes well and they say they'll call me in a day or 2 to set up a time for me to ride with a nurse (because I requested it). So as I'm walking out, I run across an individual who worked at the prison I did a travel assignment. She was the educator during my orientation, and it was quite painful. For example, I took a 2 minute break after a test to use the restroom and introduce myself to the staff and she jumped my case in the nursing station telling me I have no time to dilly dally. Fortunately, she was gone the next week. Point being that I didn't hear from them after 3 or so days so I call them and they say they don't have anyone available to train me. Of course I'll never know if the former prison educator made some type of statement to the home health people about me being a dilly dallier, but I went from being treated like the best thing since sliced bread to someone they don't want anything to do with, so it made sense.

It certainly sucks, but bleh...their loss. I might not have found my dream job as a crisis responder if not for getting denied the home health job.

Their loss indeed! I understand that rejection feeling, even if it wasn't exactly (or who exactly) you wanted, being told 'no, we don't want you' hurts in some way.

And as for those people at work who 'noone likes', sometimes they dig their own graves.

I've been thrown in the reject heap more times than I can count, and I have good references, too. The local hospital here is very clique-ish and refused to even talk to me (it's a hick joint) and every time I have applied at the local nursing home I get an interview and such but they never call back. This has left me always having to get a job that requires running the wheels off my car.

This hospital actually had the nerve to send me an invitation to a job fair recently. Well, I guess it was intended for me. They got the first name totally wrong (not even close) but since they did manage to get the last name correct (and I don't have a very common last name) I assume it was for me. I'd thought about tearing it in two and sending it back to them with a friendly note...but I didn't feel it was worth the bother.

I also got a letter from the board of nursing that included a survey to fill out. They are wanting insight on the reasons for the nursing shortage. I'm going to send it back and ask them to tell me where there is a nursing shortage so I will know where to apply for a job because everywhere I go nurses must be insurplus because these employers sure seem to be able to pick and choose.

I'm working private duty right now, and working on my MT certificate. If worse comes to worse I know where there is a nursing home where I will always have a job, but it stinks when you're given the cold shoulder for no good reason.

Sorry you're upset. Can't say I wouldn't be either.

I have a philosophy that I live by & so far has not done me wrong... Everything happens for a reason... as odd as that may sound I believe it to be true... There were many things that I had hoped for & thought I should & did deserve, but for one reason or another it didn't worked out as I had hoped...but 9.5 times out of 10 I got a better deal in the end. You'll find another place that is the perfect fit for you.

Thanks for all the replys. I noticed that some of you said something about always being nice to people or it may turn and bite you in the butt. I was always nice to this nurse, but she was one of those people that no matter what you did, she didn't like you. In the family practice clinic that I worked with her, they didn't even throw her a going away party. She was mean to the patients and coworkers, and unfortunately for me I was honest at my interview and admitted to knowing her. I to believe that everything happens for a reasons, but it doesn't mean you don't get your feelings hurt in the interim. I;m 36 years old and this is one of the first times that politics has really burned me and it didn't feel good. I'll get over it and move on and be thankful that atleast at my present employer is kind to me. I just was looking for another job closer to home that might pay a little better and the job I was denied met that criteria. The pay where I work now is low and it's a heck of a commute.
